Current legal status

Overlays the 11 September 2025 Rules amendment (G.S.R. 610(E)) and the Jan Vishwas (Amendment of Provisions) Act, 2026 changes effective 22 June 2026 (advisory/warning definitions, substituted sections 30 and 31, new section 31A, omission of section 37(2)). The April 2026 MSDE portal order's 18% cap is flagged separately as an operational portal control, not a rewrite of the statutory Rule 7B(3) annual band (2.5%–15%, with the 5% fresher/skill-certificate reservation).

Common control failures

Publishing the older fine-only text for sections 30/31 instead of the 2026 advisory-warning-penalty ladder; treating the April 2026 portal 18% cap as a rewrite of the statutory Rule 7B(3) 2.5%–15% band; missing the 5% fresher/skill-certificate reservation; assuming government scheme support (NAPS/NATS) replaces the employer's own statutory stipend obligation; and omitting section 31A (operative 22 June 2026).

Questions and answers

Is this hub a substitute for the official law?

No. It is an explanation and control layer. The official Act, Rules, notifications and portal instructions govern.

What date is the legal position based on?

Does the 18% portal cap replace Rule 7B(3)?

No. Rule 7B(3)'s statutory annual band is 2.5%–15% (including contractual staff, with a 5% fresher/skill-certificate reservation). The April 2026 order's 18% figure is an operational portal control, not a rewrite of the Rule.

Does NAPS/NATS scheme support replace the employer's stipend obligation?

No. Government scheme support is additional; it does not replace the employer's own statutory stipend obligation under the Act and Rules.

Are state overlays included?
