Rule 7D: Minimum gap between trainings

Rule purpose

Rule 7D operationalises section(s) 7 of the Apprentices Act and should be read with the applicable Schedule, curriculum, portal workflow and adviser directions.

Current amendment overlay: Inserted in 2025: minimum one-year gap after completed training; specified exceptions; three-month waiting period after certain apprentice-initiated terminations (no waiting period for women); maximum two trainings in different trades; Central stipend support restricted to first-time training; bar after apprentice default termination.

Employer implementation

  • Use the current portal fields and contract format, but retain an offline legal checklist so portal configuration does not become the only control.
  • Map every apprentice to category, qualification, trade, duration, stipend, supervisor and approving authority.
  • Keep dated screenshots/acknowledgements for registration, changes, termination, stipend and reporting.
  • Escalate State/jurisdiction and adviser questions before onboarding rather than after a portal rejection.

7D. Minimum gap between trainings.—(1) There shall be a minimum one-year gap between two apprenticeship trainings after completion of the previous training, except where the previous training ended due to employer failure.

(2) A three-month waiting period applies where the apprentice terminated for health, financial hardship, relocation, transport, career-change or language-barrier reasons; no waiting period applies to women.

(3) A person may undergo a maximum of two apprenticeship trainings and the second may not be in the same trade.

(4) Central Government stipend cost is restricted to first-time training.

(5) Apprentice-default termination bars another contract under the Act.
