Workplace is functional, not only physical

The statutory definition covers places visited during employment and should be applied to work-linked digital spaces and remote interactions with the facts and developing case law in view.

Policy coverage

Expressly cover work email, messaging groups, video calls, collaboration platforms, employer events, travel, accommodation, client sites and employer-arranged transport. Preserve messages and metadata lawfully and restrict access.

Jurisdiction and forum

For distributed teams, document the employing entity, administrative unit, committee coverage, complainant work location and appropriate Local Committee route. Avoid using remote work to deny access to a functional forum.

Primary provisions

Use the section and rule repository and the source register. Apply State rules, service rules and current forum details before acting.
