POSH practical guide
Applicability, coverage and threshold
Finin2min operating guidance linked to the Act, Rules and current official implementation material.
Who is protected?
An aggrieved woman can be of any age and need not be employed at the workplace. The employee definition includes regular, temporary, ad hoc, daily-wage, contract, probationary, trainee, apprentice, voluntary and other work arrangements.
What is a workplace?
The definition includes government and private organisations, hospitals, educational and sports locations, places visited during employment, employer-provided transport and a dwelling place or house.
Which committee?
| Situation | Forum |
|---|---|
| Workplace has ten or more workers | Internal Committee under section 4. |
| Workplace has fewer than ten workers | District Local Committee under section 6. |
| Complaint is against the employer | District Local Committee, regardless of the Internal Committee route. |
Do not use “more than ten” as the legal threshold without analysis. Section 6 applies where the establishment has fewer than ten workers; ten is therefore outside that exception.
