Aureliano Fernandes judgment - 12 May 2023

The Supreme Court stressed full implementation of the Act and Rules, proper committee constitution, visibility of committee details, training and adherence to natural justice.

Continuing implementation proceedings

Subsequent orders have examined District Officer, Local Committee, nodal officer, public and private workplace survey, SHe-Box and reporting compliance across States and Union Territories. The 6 January 2026 order continued directions on nodal officers, surveys, data and publicity of SHe-Box; proceedings continued in February 2026.

Employer takeaway

A paper committee is not enough. Demonstrate current composition, accessibility, trained members, actual complaint-handling capability, portal data and recurring governance oversight.

Primary provisions

Use the section and rule repository and the source register. Apply State rules, service rules and current forum details before acting.
