ESI General Regulations: current status and 2026 transition

A source-led guide to the 1950 General Regulations, their continued relevance during transition, and the approved 2026 replacement framework under the Code on Social Security.

Current control: India Code lists the Employees’ State Insurance (General) Regulations, 1950 under the ESI Act. In 2026, the ESI Corporation approved framing revised General Regulations under the Social Security Code. Approval must not be treated as Gazette notification or operative commencement without the final instrument.

What applies?

  1. Identify the contribution, benefit, certification, claim, employer or insured-person event date.
  2. Confirm whether the ESI Act, the Social Security Code or a saved transition provision controls that event.
  3. Read the exact 1950 Regulation and all applicable amendments for the legal period.
  4. Check whether final 2026 Regulations have been published in the Gazette and brought into force.
  5. Apply current ESIC directions and portal procedure only to the extent consistent with the governing legal instrument.
