Legal status

The Code on Social Security, 2020 repealed the ESI Act, 1948. Section 164(2)(b) preserves ESI rules, regulations and schemes for one year from the Code’s commencement, only to the extent not inconsistent with the Code; section 164(2)(a) separately protects prior actions under its savings conditions.

2026 replacement watch: ESIC approved framing of revised General Regulations on 30 June 2026. This repository does not label them final or operative without a Gazette replacement. Read the status control.

Then use saved regulation

Apply the 1950 operational detail only where consistent and not replaced.
