Rule 6: Complaint of sexual harassment by another person

6. Complaint of sexual harassment. - For the purpose of sub-section (2) of section 9,- (i) where the aggrieved woman is unable to make a complaint on account of her physical incapacity, a complaint may be filed by her relative or friend; her co-worker; an officer of the National Commission for Women or State Women's Commission; or any person who has knowledge of the incident, with her written consent; (ii) where she is unable to complain on account of mental incapacity, a complaint may be filed by her relative or friend; a special educator; a qualified psychiatrist or psychologist; the guardian or authority under whose care she is receiving treatment or care; or a person with knowledge of the incident jointly with one of those persons; (iii) where she is unable to complain for any other reason, a person with knowledge of the incident may file with her written consent; (iv) where she is dead, a person with knowledge of the incident may file with the written consent of her legal heir.
