How to apply this provision

  1. Primary statutory test — An employer of an establishment shall— (a) maintain register in prescribed form, electronically or otherwise, containing such particulars of workers as may be prescribed by the appropriate Government including,— (i) work performed by them;
  2. Additional operative limb — (b) display notices at the work place of the workers in such manner and form as may be prescribed by the appropriate Government;
  3. Numerical or timing control — (ii) number of hours of work constituting normal working hours in a day;
  4. Central Rule mapping — 72, 73, 74, 75, 76. Read the mapped provision together with this text rather than treating the concordance as a substitute for it.
  5. Prescribed-form link recorded in the corpus — XIII, XIV, XV, XVI, XVII, XIX, XX. Confirm the current notified form/version before filing.
  6. Evidence file — retain facts and records proving the role/status of: Employer, Worker, Appropriate Government, Inspector-cum-Facilitator, Authority / officer.
Why this is section-specific: the operative-clause, exception, threshold and cross-reference panels above are extracted from Section 33 itself rather than a generic “trigger/control/evidence” template.

Worked example

When an event triggers maintenance of registers, records and filing of returns, record the trigger date, competent authority, prescribed rule/form, filing or decision step, service/acknowledgement and final outcome. A statutory point to test is: “(ii) number of hours of work constituting normal working hours in a day;” Read the mapped Central Rule(s) 72, 73, 74, 75, 76. Use the current notified XIII, XIV, XV, XVI, XVII, XIX, XX where the process requires it.

Illustration only; it is not statutory text or a substitute for applying the actual facts, jurisdiction, current rule/scheme and official instrument.
