Restaurant & Cloud Kitchen
Practical India guide to Restaurant & Cloud Kitchen: approvals, setup, operating controls, taxes, cash flow, risks, closure, 28 FAQs and editable tools.
General business education. Use the activity, location and transaction facts for legal and tax decisions; illustrative figures are not promised returns.
The two-minute answer
First decision — Cloud kitchen inside a shared premises. Map each food business operator, licence address and food-preparation responsibility separately; verify if premises sharing is permitted and how inspections access both kitchens. Second decision — Own app versus aggregator. Draw funds flow, invoicing, refund responsibility and section 9(5) tax treatment; platform payment of GST on notified restaurant service does not remove operating and income-reporting duties. Then execute — Approve the site before committing to rent. Check zoning, authorised kitchen use, exhaust route, commercial cooking fuel, drainage, waste storage and required building/fire approvals with the relevant municipality and fire officer. Make the lease conditional on feasibility where practicable; keep landlord NOC and inspection correspondence. Know the first escalation — Suspected food poisoning. Quarantine suspected batches, preserve temperature logs and ingredient invoices, care for affected consumers, follow applicable incident reporting obligations and investigate root cause before reopening the affected line. Save a dated licence/authority determination, responsible owner, signed contract, evidence reference and next review date at every material step. This is the minimum practical answer before committing capital or promising a customer outcome.
Choose your exact model before applying
| Operating model | How it changes compliance | Minimum evidence |
|---|---|---|
| Dine-in outlet | Seating and public access make municipal trade, building occupancy, signage and fire conditions especially important. | Floor plan, premises proof, kitchen layout, occupancy record |
| Delivery-only kitchen | An aggregator listing does not substitute for the food business operator’s own FSSAI status or delivery hygiene. | FSSAI number, delivery handover temperature log, platform agreement |
| Packaged foods line | Prepacked products can trigger label declarations, weights, shelf-life and SKU-specific standards beyond food service. | SKU master, product labels, traceability and batch records |
Six practical steps — registration to operation
Map the menu, premises and transaction chain
Prepare a separate list of dine-in meals, takeaway packs, online orders, catering, bakery products and any alcohol sales. Record who invoices the customer and collects money, which kitchen cooks the item, and whether the platform merely facilitates orders. This determines FoSCoS category, separate local licences and the applicable restaurant-service/e-commerce GST treatment.
Register the food business correctly
Use the FoSCoS Kind of Business and the current certificate/portal record. The April 2026 schedule lists restaurants up to ₹1.5 crore under registration, above ₹1.5 crore up to ₹50 crore under State licensing, and above ₹50 crore under Central licensing. Caterers, food importers and e-commerce food businesses have different category rules. Check certificate status, continuing fees, modifications and operating obligations; do not assume an old certificate automatically changes category or that continuing compliance disappears.
Clear the site and cooking line
Obtain premises owner consent, local trade permissions where applicable, fire/smoke-extraction approvals as required by location and fuel equipment, and water/waste arrangements. Design raw/cooked segregation, allergen communication, drainage, pest control, cold-chain and handwashing stations. Ask the municipal/fire authority to record its specific applicability decision.
Operate a safe procurement and temperature system
Approve ingredient suppliers, check labels and expiry, log receipt and stock rotation, keep oil management and cleaning registers, maintain pest-control records and trace a customer complaint to purchase and production batch. Staff training must cover cross-contamination, hand hygiene, storage, food-contact packaging and allergens; update SOPs after inspection findings.
Set up invoicing and aggregator reconciliation
Before charging GST, identify the exact supply and notified rate, whether the customer is served in specified premises, and whether section 9(5) makes the e-commerce operator liable on the restaurant service. Match each online order to gross menu value, platform deductions, incentives, taxes, refunds and bank settlement; do not simply book the net bank receipt as turnover.
Prove unit economics rather than footfall
Test food cost, discounting, packaging, aggregator commission, labour, rent and spoilage by channel. A profitable counter order may become loss-making on the delivery app. Maintain a daily order dashboard: orders × net realisation per order less direct ingredients, packaging and channel costs, then deduct monthly fixed operating expenses.
Regulatory applicability and authority matrix
| Statute / regulator | What triggers it | What to verify | Keep on file |
|---|---|---|---|
| Food Safety and Standards Act/FoSCoS | All food preparation, storage and sales by the FBO; Kind of Business and location determine licence/registration. | Match FoSCoS category to location; keep status and display particulars. | FoSCoS acknowledgement, certificate, inspection record |
| Local trade/fire and premises rules | Location, seating, cooking fuel and public access differ by municipality. | Confirm with the municipal/fire authority before fit-out. | Lease/NOC, applications, certificates, layout |
| CGST Act and rate notifications | Restaurant service versus packaged goods and platform-facilitated supply. | Document actual SAC/HSN, tax liability and ITC restrictions against CBIC notifications. | Tax matrix, invoices, platform settlements |
| Labour Codes and State implementing rules | Worker hiring, food handling, hours, wage, social security and welfare. | Issue appointment terms and assess establishment-specific obligations. | Personnel file, training and wage evidence |
GST, income tax and cash-recognition decisions
| Transaction / obligation | Assessment and treatment |
|---|---|
| Restaurant meals | Determine current service rate and conditions from notified GST schedules; never apply a historic percentage to all outlets. |
| Aggregator orders | Check section 9(5) notified restaurant service rules and reporting/reconciliation; an operator-paid GST does not erase commercial income. |
| Packaged goods and catering | Product HSN, supply type and invoice pattern may differ materially from restaurant meals. |
| Direct tax | For tax year 2026-27, apply Income-tax Act, 2025 / Rules 2026; maintain sales, purchase and cash trail and evaluate applicable audit/TDS obligations. |
Forms, registers and evidence checklist
| Document / record | What to include | Owner / authority |
|---|---|---|
| Food application | FoSCoS registration / licence, kind-of-business and location particulars | FSSAI portal |
| Kitchen safety | Equipment, water testing, cleaning, pest control, training and temperature evidence | Site file |
| Local permissions | Municipal trade, fire and signage permissions when applicable | Local authority |
| Sales and GST | Order-level invoices, platform settlement and return reconciliation | Billing system |
| Labour | Appointment documents, wage and safety records | Payroll file |

Financial model: revenue, profit and cash are different
| Input or result | Value | Meaning |
|---|---|---|
| Monthly volume | 3,000 retained orders | Retained, accepted or billable output—not merely enquiries/dispatches |
| Realised price | ₹320 | Net of refunds and indirect tax |
| Variable cost per unit | ₹185 | Direct cash costs allocated to the same billable unit |
| Fixed operating cash cost | ₹280,000 | Excludes depreciation, finance charges and income tax |
| Contribution per unit | ₹135 | Price minus variable unit cost |
| Break-even volume | 2,075 retained orders | Fixed cost ÷ contribution, rounded up |
| Capacity utilisation | 60.0% | Volume ÷ illustrative safe/saleable capacity |
Worked calculation: 3,000 × (₹320 − ₹185) = ₹405,000 contribution; less ₹280,000 fixed cash costs leaves ₹125,000 before financing, depreciation, tax and capital expenditure. A 10% fall in volume alone reduces contribution by ₹40,500. A 10% rise in unit variable cost alone reduces it by ₹55,500.
A profitable order can still produce a settlement loss
A delivery kitchen sells the same dish through its own counter and two platforms. The menu price is identical, but one channel funds discounts from the kitchen and settles refunds a week later. Comparing bank receipts with food purchases makes that channel appear profitable until promotion and refund deductions arrive.
Work through the decision
Reconstruct one completed order and one cancelled order for each channel. Bridge menu value to the invoice, food and packaging consumption, commission, coupon funding, delivery obligation, taxes or withholding where applicable, and the bank settlement. Use recipe yield rather than purchase weight for food cost. Separate unexplained deductions from agreed commercial charges.
What to establish before proceeding
Set a channel-specific minimum retained-order contribution and reconcile disputed deductions before opening another kitchen. Keep the order ledger, platform contract, recipe-cost card, refund authorisation and settlement evidence together. A second brand does not remove premises or food-activity classification questions.
| Operating measure | Definition and use |
|---|---|
| Retained-order contribution | Revenue for fulfilled, non-refunded orders less recipe, packaging, channel and delivery-variable costs; compare by channel. |
| Ingredient yield variance | Standard recipe consumption for fulfilled dishes compared with actual stock issued, explaining waste and portion differences. |
| Settlement exception value | Unexplained platform deductions and timing differences aged by settlement date, not written off as commission. |
This example is Finin2min’s operating analysis. Its commercial assumptions are not quoted market terms or a permit determination.
Common mistakes and how to avoid them
- Old FSSAI ₹12 lakh threshold. 2026 revised eligibility changes classification; check category exceptions.
- Assuming GST applies uniformly. A dine-in sale, online restaurant service and packaged item can take different paths.
- Ignoring aggregator economics. Commission, promotion and tax adjustments are not interchangeable deductions.
- Opening without fire and waste sign-off. Fuel type and local plan approvals often determine whether the premises are usable.
Practical 30/60/90-day implementation plan
| Period | Specific milestone |
|---|---|
| Days 1–30 | Cost the launch menu after yield loss; test extraction, drainage, cold storage and the proposed food-business category. |
| Days 31–60 | Run controlled orders through each channel; test allergen handling, dispatch evidence and cancellation reconciliation. |
| Days 61–90 | Compare retained-order contribution and waste by channel; expand hours or menu only after kitchen capacity and cash are demonstrated. |

Which business model changes the legal answer?
| Situation | Exact action and proof of decision |
|---|---|
| Cloud kitchen inside a shared premises | Map each food business operator, licence address and food-preparation responsibility separately; verify if premises sharing is permitted and how inspections access both kitchens. |
| Own app versus aggregator | Draw funds flow, invoicing, refund responsibility and section 9(5) tax treatment; platform payment of GST on notified restaurant service does not remove operating and income-reporting duties. |
| Add bakery packaged goods | Check separate KoB, label declarations, allergens, batch, best-before, net quantity, Legal Metrology and GST HSN rather than treating all revenue as restaurant service. |
| Plan to serve alcohol | Alcohol regulation and excise approvals are State-specific; do not assume a food licence or GST invoice can authorise alcoholic beverage supply. |
| Operate 24-hour outlet | Check local trading hours, noise, night shift workplace safety and police/municipal conditions; retain written applicability position. |
| Franchise kitchen brand | Define who owns FSSAI registration, food quality, customer refunds, intellectual property and local taxes in the agreement before marketing begins. |
Complete execution SOP: what to do, in order
Approve the site before committing to rent
Check zoning, authorised kitchen use, exhaust route, commercial cooking fuel, drainage, waste storage and required building/fire approvals with the relevant municipality and fire officer. Make the lease conditional on feasibility where practicable; keep landlord NOC and inspection correspondence.
Register the actual food operations
Create a FoSCoS activity matrix by premises: restaurant, caterer, manufacturer, storage, importer or other Kind of Business. Apply the current 2026 criteria, but test category-specific Central-licence triggers separately. Retain application, owner details, supporting premises documents and displayed approval.
Commission food-safety stations
Prepare receiving, washing, preparation, cooking, cooling, packing and dispatch flow; assign handwashing, allergen segregation, calibrated temperature measurement, pest control and cleaning schedules. Set rejection criteria for deliveries and an owner to sign every exception.
Map food and online-order taxes
List dine-in, takeaway, delivery through e-commerce operator, own delivery, catering and prepacked foods separately. Validate current CBIC rate notifications and CGST section 9(5) platform liability for applicable restaurant service before setting billing software. Document invoice issuer and revenue-recognition gross/net reconciliation.
Run a safe first-week trial
Test each recipe for yield and ingredient cost; process a simulated online refund, an allergen complaint and a cold-chain failure. Match point-of-sale orders, delivery-platform deductions, sales register, cash book and payment gateway bank credits daily.
Close books and renew operating controls
Monthly review food cost by SKU, wastage, platform margins, safety logs, complaint closure and statutory filings. Quarterly review ingredients, supplier declarations, local licences and newly introduced packaged-food lines before expanding menus.
What to do when something goes wrong
| Real-world problem | Action, evidence and remedy |
|---|---|
| Suspected food poisoning | Quarantine suspected batches, preserve temperature logs and ingredient invoices, care for affected consumers, follow applicable incident reporting obligations and investigate root cause before reopening the affected line. |
| Supplier product recall | Stop sale and use of the lot, map batch-to-order distribution, contact customers where required and document disposal/return with supplier and applicable FSSAI recall process. |
| Aggregator short settlement | Reconcile order ID, commission, promotions, tax, customer refund and payout; dispute variance within contractual window instead of writing off the difference. |
| Inspection non-compliance | Record observations verbatim, close food hazards immediately, submit documentary proof within the actual order deadline and do not conceal unresolved violations. |
| Repeated negative contribution | Reprice loss-making SKUs, cap promotions and platform costs, revise portion control and test a channel-level break-even before seeking more volume. |
Contract clauses and counterparty safeguards
- List exactly which brand and kitchen is responsible for preparation and refunds
- Define platform commission, promotions, settlement timing and dispute window
- Require supplier batch traceability, allergen disclosure and recall assistance
- Allocate ownership of restaurant licences, local safety approvals and indemnities
- Clarify packaging returns, customer data and advertising obligations

Stress tests, funding and month-end finance
| Stress / funding item | Illustrative result | Decision |
|---|---|---|
| Volume −20% and unit cost +10% | ₹-400 monthly operating result | Reduce avoidable fixed costs, reprice or improve retained volume before adding debt |
| An extra 30 days of collection delay | ₹960,000 additional receivables | Profit is unchanged initially, but cash is locked up |
| Startup equipment cash | ₹1,500,000 | Separate capital expenditure from operating cost |
| Refundable lease deposit | ₹300,000 | Not an ordinary monthly expense |
| Opening liquidity buffer | ₹600,000 | A planning assumption—not proof the business is adequately funded |

Commercial and legal decisions before spending
Select an outlet model before committing to rent
A delivery kitchen, dine-in restaurant, caterer, packaged-food manufacturer and food importer do not share one permission or margin structure. Write down each revenue stream and preparation/storage address. Separate menu delivery from the manufacture of shelf-stable branded products; adding catering or imports can change the FoSCoS category even when sales are modest. Make lease commencement conditional on permitted use, exhaust routing, electrical load, LPG arrangements and food-business eligibility.
Price the order that survives refunds
Build the menu from recipe yields and edible portions, not the purchase weight alone. For each retained order, deduct ingredients, spoilage, packaging, the contractual platform commission, promotion share, delivery subsidy and expected refunds. A platform bank settlement is neither gross sales nor the final taxable value. Reconcile order ID to invoice, discount funding, commission invoice, cancellation, withholding and settlement. Run a contribution calculation separately for direct orders, marketplaces and catering.
Treat hygiene as a traceable operating system
Approve suppliers with food-business credentials relevant to what they sell. Record receipt temperature where required, batch/expiry, cold-storage temperatures, cleaning and pest-control completion, food-handler fitness and allergen information. Use first-expiry-first-out for dated ingredients. If a customer alleges contamination, isolate the batch, preserve order and supplier evidence, arrange medical help where needed and follow the competent authority’s reporting instructions; do not discard all evidence or continue selling an implicated batch.
Measure demand before expanding the menu
Trial the menu and delivery radius in a lawful operating environment. Compare repeat purchases, preparation minutes, waste per dish, late delivery and retained-order contribution. A high-ticket item can still be unattractive if it occupies the bottleneck station during peak demand. Keep an approved substitution list for supply shortages and obtain customer agreement for material changes rather than silently replacing allergen-sensitive ingredients.

Approvals: authority, process and completion evidence
Restaurant food activity
Authority: FoSCoS / State food-safety authority
Process: Select restaurant Kind of Business and each premises; apply with the portal’s current identity, possession, activity and food-safety documents. The April 2026 schedule uses registration up to ₹1.5 crore, State licence above ₹1.5 crore through ₹50 crore and Central licence above ₹50 crore.
Completion evidence: Application reference, issued registration/licence, approved activity/address and operating conditions; schedule page 7.
Catering, food imports or marketplace operation
Authority: FoSCoS
Process: Classify separately. The schedule places caterers up to ₹50 crore in State licensing and above that in Central licensing; food importers and e-commerce food businesses are Central categories irrespective of turnover. Selling food on someone else’s platform is not automatically operating that platform.
Completion evidence: Kind-of-Business decision and category-specific certificate; schedule pages 6–7.
Cooking premises and fire safety
Authority: Municipality, fire authority and competent utility
Process: Submit the actual layout/use/capacity, possession/NOC and required safety documents. Resolve exhaust, waste water, grease, LPG and evacuation conditions before opening.
Completion evidence: Applicable approvals or documented non-applicability; inspection closure and equipment service records.
Menu invoicing and platform sales
Authority: GST portal / CBIC classification
Process: Map restaurant service, packaged goods, catering and e-commerce section 9(5) treatment separately. Reconcile platform reports with the supplier’s own filing obligations; do not infer all liabilities are discharged by an aggregator.
Completion evidence: Supply-wise tax position, invoice samples and settlement reconciliation.
Application passport: from eligibility to approval
Permissions, prescribed forms, fees and professional review
Food-business registration or licence
Facts that determine applicability: Identify restaurant, caterer, manufacturer, importer and every preparation/storage address.
Competent authority: FSSAI / designated licensing authority through FoSCoS
Application and prescribed form: Select the actual Kind of Business in FoSCoS; retain the generated application and certificate. The linked eligibility schedule is not an application form.
Fees and funding: Restaurant row: annual turnover up to Rs 1.5 crore — Rs 100/year registration; above Rs 1.5 crore to Rs 50 crore — Rs 5,000/year State licence; above Rs 50 crore — Rs 7,500/year Central licence. Category exceptions apply.
Completion evidence: KoB selection, turnover basis, premises proof, submitted application, fee receipt, certificate and conditions.
Question for the relevant professional: Does catering, food manufacture, import or a special location change the category despite modest turnover?
Hotel specified-premises declaration
Facts that determine applicability: Relevant where restaurant operations are linked to a hotel/accommodation business.
Competent authority: Jurisdictional GST authority
Application and prescribed form: Notification 05/2025–CTR: Annexure VII registered-person opt-in; VIII new-registration opt-in; IX opt-out. Use the exact prescribed annexure.
Fees and funding: The notification does not specify a separate declaration fee; that is not a finding that every associated filing/service is free.
Completion evidence: Previous-year accommodation value analysis, chosen annexure, premises-wise acknowledgement and period.
Question for the relevant professional: Is the hotel within the specified-premises definition and which tax entry/ITC condition governs the restaurant supply?
Local kitchen and premises permissions
Facts that determine applicability: Check actual commercial use, kitchen/exhaust/LPG plan, seating, building and location.
Competent authority: Municipality, fire authority and other competent State/local authorities
Application and prescribed form: Identify each named local application before signing an unconditional lease.
Fees and funding: Use the actual municipality/category/area/period schedule; separate permit fees, deposits and professional charges.
Completion evidence: Approved use and plans, lease/NOC, applicable permits, inspection closure and expiry diary.
Question for the relevant professional: Can the intended food operation lawfully run at this address and are any conditions outstanding?
Prepare the decision file
Daily controls, review rhythm and escalation
Daily: opening food-safety check, stock issues, temperature exceptions, cancelled orders and cash/UPI reconciliation.
Weekly: recipe yield versus actual consumption, expired inventory, platform recovery claims and supplier-credit reconciliation.
Monthly: channel contribution, repeat-customer cohorts, waste value, payroll, input-tax eligibility and liquidity before rent and debt service.
Respond to an incident without destroying evidence
Exit, sale, closure and continuing liabilities
On closure, stop taking orders beyond fulfilment capacity, refund unserved advances, dispose of food safely, settle employees and suppliers, surrender or amend food and local permissions through the relevant authority, and preserve complaint/traceability records. A sale of equipment or brand does not automatically transfer the food licence or lease.
Closing evidence and liabilities
Business-specific questions answered
Is an FSSAI licence renewed annually?
Use the FoSCoS Kind of Business and the current certificate/portal record. The April 2026 schedule lists restaurants up to ₹1.5 crore under registration, above ₹1.5 crore up to ₹50 crore under State licensing, and above ₹50 crore under Central licensing. Caterers, food importers and e-commerce food businesses have different category rules. Check certificate status, continuing fees, modifications and operating obligations; do not assume an old certificate automatically changes category or that continuing compliance disappears.
Do I need separate approvals for each kitchen?
Map each location and Kind of Business in FoSCoS; do not assume one address certificate covers separate units.
Are cloud-kitchen sales taxed like packaged retail snacks?
Not necessarily. Restaurant service, prepacked goods and platform supplies must be analysed separately.
Does the aggregator take care of every compliance?
No. Platform tax treatment does not displace the kitchen’s food safety, labour, traceability and local premises obligations.
The answers below address common real-world situations. Each must still be matched to the operator’s actual facts, current tax notification and State/local rules.
Can I start a home cloud kitchen without any registration?
Food prepared for sale is a regulated food-business activity. Check FoSCoS for the correct category and the locality’s residential-use, fire and waste conditions; working from home is not an automatic exemption.
How do I decide between FSSAI registration and a licence in 2026?
From 1 April 2026 the revised general turnover bands are up to ₹1.5 crore for registration, above ₹1.5 crore through ₹50 crore for State licence, and above ₹50 crore for Central licence. Check the precise FoSCoS Kind-of-Business exceptions; for example, certain activities may require Central licensing irrespective of turnover.
Can one kitchen sell under three brand names?
A virtual brand is not by itself a separate premises, but the legal food operator, activity, product nature and establishment record must be correctly disclosed. Keep traceability and invoice disclosures for every brand.
What if my electricity or cold room fails overnight?
Use temperature excursions and time-out-of-refrigeration rules in the written food safety plan. Quarantine affected perishables; record power failure times, thermometer readings, disposal and repair.
What evidence should I keep for an online order complaint?
Retain order ID, batch/time of cooking, dispatch/temperature log, ingredients and staff shift details, customer communication, refund decision and corrective-action record.
Does an aggregator collecting money mean my sales equal the net payout?
No. For commercial accounts reconcile the gross order value, discounts, GST responsibility, fees, refunds and TCS/TDS where relevant against net bank credits; account for each element under applicable standards.
Is it compulsory to employ a qualified chef?
Hiring requirements depend on the food activity and applicable food-safety supervision/training conditions; verify current FSSAI FoSTaC and local requirements rather than assuming a specific chef certificate suffices.
Are unbranded loose pastries and packaged cakes taxed alike?
Not necessarily. Evaluate supply nature, packing, HSN/SAC, product notifications and whether the transaction is restaurant service or supply of goods.
Can I transfer my FSSAI certificate after selling the business?
Change in proprietor, entity, address or food activity can require a formal FoSCoS modification or fresh application. Check the applicable transfer/modification process before continuing operations.
What is a useful daily kitchen dashboard?
Track fulfilled orders, average ticket, food and packaging cost per order, channel commission, rejection/spoilage, complaints, service time, labour-hours and cash collected versus settlement.
How should I set a refund policy for delayed or unsafe food?
Disclose order cancellation/refund terms upfront, comply with consumer rights and platform agreements, and prioritise safety with documented complaint escalation and timely response.
Should I treat FSSAI perpetual validity as no further compliance?
No. The 2026 amendment changes validity/renewal arrangements, not the duty to comply with current hygiene, inspections, changes in activity, recall and other applicable food-safety obligations.
Can one small kitchen register as a caterer just because turnover is low?
Not automatically. The April 2026 FoSCoS table distinguishes catering from restaurants and has no basic-registration tier for the caterer row. Start with the actual activity, then apply the table; do not choose a cheaper category solely to match turnover.
How should I calculate the minimum viable selling price?
Add recipe cost after yield loss, packaging, channel charges, expected refunds and delivery subsidy. Divide the desired total contribution by realistic retained orders, then add the per-order variable cost. This is a pricing decision, not a prescribed market tariff; indirect tax must be handled separately.
Do platform payouts equal my revenue?
No. A payout can be net of commissions, promotional deductions, taxes withheld, refunds and timing differences. Book sales and deductions from underlying transaction records and reconcile the settlement to the bank; do not recognise only the net deposit as sales.
Should customer delivery fees be treated as kitchen income?
Read who supplies delivery and who is entitled to the fee under the contract. A fee collected for a separate delivery provider is not automatically your income. Keep the delivery ledger and restaurant invoice distinct where the arrangement requires it.
Can I use the same licence after moving the kitchen?
Do not assume so. A food-business certificate contains a premises/activity scope. Complete the required modification or new application for the new premises and satisfy local-use conditions before operating there.
How much working capital should a delivery kitchen hold?
Model ingredients and packaging on hand, platform settlement delays, supplier credit, rent/payroll and refund reserves. The workbook shows a cash floor and a 12-month projection. Replace its sample assumptions with your settlement agreement, purchase quotations and actual stock cycle.
How do I control an allergen complaint?
Stop the disputed dish, preserve the order and ingredient/batch records, provide urgent assistance and investigate cross-contact. Communicate factual findings, follow applicable authority requirements and revise recipes/training. A disclaimer saying customers eat at their own risk is not an adequate control.
Are restaurant service and a sealed snack packet always taxed identically?
No. A restaurant service and an independently sold packaged product can have different classifications and input-credit treatment. Maintain a supply master by product/service and contract; do not apply the dining invoice rate across all retail SKUs.
What should the platform contract specify?
Commission basis, tax on commission, who funds coupons, refund approval, disputed deductions, settlement timing, customer-data rights, suspension and exit. Test the contract against a sample order and cancellation before signing.
How do I decide whether a second outlet is affordable?
Model the new outlet’s stand-alone rent, staff, permissions, food dispatch logistics and ramp-up losses. Shared purchasing savings do not remove site-level approvals or working capital. Expansion should pass a lower-volume scenario without using money owed for existing customer orders.
Are cash sales exempt from food or tax records?
No. Record cash, UPI, card and platform sales in one sequence and reconcile daily. Payment method does not remove food-safety, invoice or tax applicability; correct a cash discrepancy through records rather than deleting orders.
What evidence should survive a kitchen sale?
Maintain the transfer agreement, stock and equipment handover, customer refund ledger, licence-change correspondence, lease consent and outstanding claims. Give the buyer necessary traceability records through a lawful transfer, not unrestricted copies of customer data.
State/UT and city-level applicability test
- Is the chosen premises permitted for this exact business and capacity?
- Which State, city and sector permit applies to each activity and each operating location?
- Are there fire, building, waste, signage, labour or medical safety conditions for this site?
- Do thresholds, professional qualifications, inspection dates or renewals differ here?
- Has any 2026 amendment commenced, been notified or changed the relevant form/fee?
- Who is legally responsible for each filing, complaint, accident and customer refund?
