QuestionWorking answer
What changed? The IFSCA Act, 2019 inserted section 33A, effective from 1 October 2020, to align the regulator for financial products, services and institutions in an IFSC.
What remains? The CICRA Act, Rules, Regulations and valid directions remain the substantive framework unless a competent IFSC instrument provides the applicable detail.
Which regulator receives the filing?Classify the entity, activity, place and instrument. Do not route a matter to IFSCA merely because a group company has an IFSC presence.
What about mixed operations?Separate the IFSC activity and regulated entity from domestic operations, then map each obligation and regulator.

Regulator-routing workflow

  1. Identify entity
Record licence, registered office, branch and regulated capacity.
  2. Locate activity
Map data collection, processing, access, reporting and customer relationship.
  3. Read instrument
Confirm whether the operative rule, regulation or direction assigns the function to RBI or IFSCA.
  4. Preserve response
Keep filing, acknowledgement, clarification and supervisory correspondence by regulator.

Example and Q&A

Example: A domestic credit institution uses an IFSC group service company for analytics. The presence of the vendor in the IFSC does not by itself transfer supervision of the domestic credit institution's CICRA obligations. Document the legal entity performing each regulated act and the authority named in the applicable instrument.

Did section 33A replace RBI everywhere? No. Can one registration cover every group entity? Apply the licence and entity-specific framework. What is the best evidence? The statutory text, current regulatory instrument, licence scope and regulator correspondence.
