Slump sale accountant report form. 285. (1) For Schedule VI [Table: Sl. No. 10], capital-gains income of a specified fund attributable to units held by a non-resident (not being a permanent establishment of a non-resident in India) is computed, where the fund files Form No. 178 under sub-rule (2), as (A x B)/C, where A = capital-gains income from transfer of shares of an Indian-resident company received by the fund (as resultant fund) on relocation from the original fund or its wholly-owned SPV, where such gains would not have been chargeable but for the relocation; B = aggregate daily assets under management held by non-resident unit holders from acquisition to transfer of the share; and C = aggregate daily total assets under management over the same period. Where Form No. 178 is not filed, the exempt income is nil. (2) The specified fund shall furnish an annual statement of exempt income in Form No. 178 electronically under digital signature by the due date. (3) The fund shall have that annual statement certified by an accountant (as defined in section 515(3)(b)) before the specified date, with the accountant furnishing the certificate in Form No. 179 electronically under digital signature. (4) For this rule, "assets under management" means the closing balance of the fund's asset/investment value on a given date; "due date" has the meaning in section 263(1)(c); "original fund," "relocation," "resultant fund," "securities," "specified fund" and "unit" have the meanings assigned in Schedule VI; "permanent establishment" has the meaning in section 173(c); and "specified date" means one month before the due date.
