The Two-Minute Answer

Reconcile gross taxable income before TDS and separate interest from principal or sale proceeds. TDS is a credit, not a substitute for computation.

This page answers the questions readers ask most: which return, which deadline, which schedules and which documents? It does not treat a broker, bank, app or platform label as the legal answer.

Step 1 — Classify the Income

The return form follows the legal head and taxpayer profile. The starting classification is Capital gains with possible advance-tax shortfall and the likely form is ITR-2 unless business income requires ITR-3. The final form applies to the taxpayer as a whole: salary, rent, gains, business and other income are combined in one correct return rather than split into separate returns.

Classification should be documented before tax is calculated. Review ownership, intention, contracts, frequency, funding, books, services, foreign status and consistency with earlier years. The same product may be an investment for one person and stock-in-trade for another.

Step 2 — Compute the Taxable Amount

Compute the actual capital gain (sale consideration less cost, and less indexation where still applicable) and classify it as short-term or long-term based on the holding period for that specific asset class - the rate and any exemption depend entirely on this classification, not on when in the year the gain happened to be realised.

Because this gain arose late in the financial year, it could not have been estimated when the June, September or December advance-tax instalments were paid. Section 234C’s proviso for capital gains recognises this: no shortfall interest is charged on the EARLIER instalments for a gain that genuinely could not have been foreseen, provided the tax on it is paid along with the remaining instalments (the 15 March instalment for a March gain) or by 31 March. Reconcile the full-year gross gain to AIS and Form 26AS before relying on this exception - it protects against the earlier instalments only, not against final tax due.

Step 3 — Apply the Filing Calendar

The normal filing timing is 31 July 2026 for ITR-2. For AY 2026–27, ITR-1 and ITR-2 individual cases remain on the 31 July track; non-audit business or professional cases move to 31 August; ordinary audit cases remain 31 October and transfer-pricing cases 30 November. A belated return is generally available to 31 December 2026, subject to earlier assessment completion, but it does not preserve every loss or procedural right.

Income earned during FY 2025–26 remains governed by the Income-tax Act, 1961. The official transition FAQ confirms that the old forms and proceedings continue for AY 2026–27. Advance-tax note: Compute advance-tax instalments and statutory timing relief for income that could not be estimated earlier.

Step 4 — Build the Evidence File

The file should allow another reviewer to reproduce the number from source statement to ITR schedule. Record the download date because platform reports can later change layout or aggregation.

Worked Indian Example

An investor sells listed shares on 20 March 2026, realising a long-term capital gain of ₹12 lakh with tax payable of ₹1.5 lakh (12.5% LTCG, no earlier advance-tax instalments paid on this gain since it did not exist in June, September or December). Because the gain arose after the third instalment date, the investor pays the full ₹1.5 lakh along with the 15 March instalment. Under the Section 234C proviso for capital gains, no shortfall interest applies to the June/September/December instalments for this specific gain, since it could not have been estimated earlier and the tax was paid with the next instalment falling due. Had the investor instead waited until filing the return in July to pay this tax, interest under Section 234C (and potentially 234B) would have applied from 1 April onward, because the exception only protects a taxpayer who pays with the immediately following instalment, not one who simply pays it later at filing time.

Finin2min Decision Checklist

Finin2min Q&A

Which ITR should I use for Late Capital Gain in March?

The starting answer is ITR-2 unless business income requires ITR-3. The alternative is ITR-2 / ITR-3 where those facts apply.

What is the AY 2026–27 filing deadline?

The normal deadline is 31 July 2026 for ITR-2. Audit, transfer-pricing, belated or correction facts can change the calendar.

Which income head applies?

The starting classification is Capital gains with possible advance-tax shortfall. Contracts, ownership, records, intention and consistency can alter the result.

Does a small amount still need reporting?

A small amount does not create a general exemption and can make a simplified return ineligible.

Which documents should I preserve?

Preserve interest certificate, Form 16A, AIS, Form 26AS, bank statement, instrument ledger and tax computation. Keep downloaded source files, not only screenshots.

What is the main filing risk?

Key risks are reporting net after TDS; taxing principal; claiming a deduction before aggregating income. Classify first, reconcile gross figures and then select the form.
