Governing framework
Character must be preserved transaction by transaction. Current-year set-off and future carry-forward are different questions. VDA losses are ring-fenced and cannot be set off or carried forward. Share buyback, special mutual-fund and transition items require separate classification.
Tax Year 2026–27 means income earned from 1 April 2026 under the Income-tax Act, 2025. AY 2026–27 relates to FY 2025–26 and remains under the Income-tax Act, 1961.

Worked example
STCL ₹2 lakh, listed-equity STCG ₹80,000 and property LTCG ₹1.5 lakh. STCL can absorb both, leaving ₹30,000 STCL. If the return is timely, the balance can be carried forward. An LTCL of ₹2 lakh could not absorb the STCG.

Rate is the final step, not the first
Capital-gain pages often begin with a percentage and therefore miss the decisive work: identifying the asset, statutory acquisition date, transfer event, cost rule, holding period and special deeming provision. A 12.5%, 20% or 30% rate is meaningful only after the gain has been correctly characterised. TDS or STT does not perform that classification.

- Brought-forward losses retain their ST/LT character through the 2025 Act transition: a short-term loss carried forward from an AY 2025-26 return stays short-term when set off in Tax Year 2026-27 under the new Act; the transition does not reclassify it.
- A belated return can jeopardise carry-forward even if current-year set-off remains: current-year set-off against this year’s gains still happens even on a late return, but the unabsorbed balance generally cannot be carried to future years unless the original loss return itself was timely.
- VDA negative transactions are reported as nil for the special schedule: a loss on one crypto asset cannot reduce the taxable gain on another crypto asset, let alone equity or property gains — the schedule computes each VDA transaction’s gain independently and floors any negative figure at nil.
- Wash-sale style transactions still require genuine beneficial ownership and market evidence: selling a holding to book a loss and repurchasing a near-identical position days later can be recharacterised if the transaction lacks real market risk or a genuine change in beneficial ownership — keep contract notes and settlement proof, not just the ledger entries.
