Gold Loan Auction: What Borrowers Should Know Before Default

What the rule means in practice
RBI’s Lending Against Gold and Silver Collateral Directions, 2025 create a harmonised framework for covered regulated entities, including valuation, loan-to-value, conduct and auction safeguards. The exact commencement and application to a facility should be checked against the directions and lender communication. For consumption loans, the maximum LTV is 85% up to ₹2.5 lakh, 80% above ₹2.5 lakh and up to ₹5 lakh, and 75% above ₹5 lakh; the ratio must be maintained through the tenor.

On default, the lender should provide notices and follow a transparent auction procedure under its policy and contract. Borrowers should ask for the amount required to regularise or close, the auction date, reserve-price basis and charge breakup. An auction notice should not be ignored merely because the borrower disputes one fee.
After sale, the lender adjusts legitimate dues and should return the surplus to the borrower. If sale proceeds are insufficient, the remaining liability depends on the contract and law. On full repayment, delay in releasing pledged collateral attributable to the lender can trigger compensation under the current RBI framework, subject to its conditions.

A borrower misses payments after a medical emergency. The lender issues an auction notice. Rather than sending partial money to an agent, the borrower obtains the official payoff figure, pays through the lender’s channel if feasible and gets written confirmation that auction action is stopped.
