Chapter VIIAppeal and revision

What this section provides

An order under section 29 may be appealed within one month of its communication (extendable by a further month for sufficient cause): from a Court of Session order to the High Court to which it is subordinate, and from an order of a specified officer to the Court of Session with jurisdiction. Separately, an organisation, person or association aggrieved by an order under section 5, a refusal of permission, or an order under section 12(2), 12(4) or 14(1) may appeal to the High Court within sixty days — the High Court where the appellant ordinarily resides or carries on business, or where an organisation has its principal office. These appeals are treated as appeals from an original decree, with Order XLI of the Code of Civil Procedure applying.

Section 31 deals with appeal in the inspection, seizure, confiscation, adjudication, appeal or revision framework. Preserve authorisation, inspection/seizure inventory, notices, replies, relied-on documents, order/service evidence and appeal/revision limitation calculations.
