RERA Complaint vs Consumer Commission: Which Route Needs Review?

What the buyer should understand
- RERA and the Consumer Protection Act are concurrent, not exclusive — the Supreme Court confirmed this in Imperia Structures v. Anil Patni (2020) because Section 79 of RERA bars civil courts, not consumer fora.
- Within RERA, possession/refund/registration directions go to the Authority (Section 31), while compensation claims specifically go to the Adjudicating Officer (Section 71) — filing in the wrong one wastes time even though both sit under the same Act.
- Consumer Commission jurisdiction is split by the amount paid to the builder, not the amount claimed: District up to ₹50 lakh, State ₹50 lakh–₹2 crore, National above ₹2 crore.
- An "investor" buyer purchasing purely for resale/commercial purposes may not qualify as a "consumer" under the Consumer Protection Act, but can still approach RERA regardless of purpose.
- Filing the identical relief in both RERA and a Consumer Commission at once, especially with inconsistent facts, invites an abuse-of-process objection — coordinate the two rather than run them blind.

How to apply the framework
Fix the project, phase, unit and legal actor
Identify the promoter or seller, exact registered project phase, unit, competent authority, lender and payee. Similar project names, sister companies and neighbouring phases are common sources of error. A document for another tower or phase does not validate the buyer's unit.

Reconcile public records with the contract
Compare the relevant State RERA portal, sanctioned plans, local approvals, agreement, payment schedule, tax invoices, lender records and possession documents. Save the versions relied upon. RERA registration is an important transparency control, but it is not a title certificate and does not replace independent legal, engineering, tax or valuation work.
Keep every payment and representation traceable
Pay through banking channels to the correct legal entity, obtain receipts and maintain a cumulative payment ledger. Preserve brochures, emails, messages, demand letters and written promises. Do not rely on a broker or relationship manager to reconstruct the transaction after personnel change or dispute.
Apply current tax and lending forms
Tax and loan processes can change during a long project. For property TDS, the applicable form depends on the transaction date, seller status and governing Act; the legacy Form 26QB process should not be copied into post-1 April 2026 transactions that fall under Form 141 Schedule B. For home-loan insurance, the actual issued policy wording and schedule—not the sales pitch—control cover and claims.
Choose the forum by what you actually want, not by habit
Want possession, a refund with interest, or a registration-related direction against the promoter? That is Authority territory under RERA Section 31. Want compensation specifically? That is the Adjudicating Officer's remit under Section 71. Want a wider deficiency-of-service or unfair-trade-practice remedy, or you no longer trust the RERA route for this specific builder? The Consumer Commission remains open regardless — Imperia Structures settled that RERA's existence does not oust consumer jurisdiction. Pick the Commission tier by what you paid the builder (not what you're claiming): up to ₹50 lakh paid → District Commission; ₹50 lakh–₹2 crore → State Commission; above ₹2 crore → National Commission. Possession, refund, interest, compensation, cancellation, loan restructuring and project completion can still require different evidence within whichever forum you choose. Insolvency proceedings against the promoter and existing lender security can also affect what is actually recoverable, regardless of which forum rules in your favour. Obtain qualified advice before parallel or irreversible proceedings, and before assuming a favourable order automatically translates into a recovered payment.

Before treating a milestone as complete, verify the live outcome: registered agreement, credited payment, accepted TDS statement, lender disbursement, revised amortisation, valid occupancy or completion approval, documented possession, repaired defect, society handover or registered complaint.
