How an NRI should manage Indian rental income, tenant TDS, NRO credits, house-property computation, GST questions and repatriation.

Rent is Indian-source income even when the owner lives abroad. The tenant’s withholding and the owner’s final tax are different.

Rule

Rental income from Indian property is taxable in India under the house-property or applicable head.

Money trail

Payment to a non-resident landlord generally requires TDS under section 195 rather than the resident-landlord provisions.

Tax/reporting

Gross rent, municipal taxes, statutory deduction and eligible interest determine final house-property income.

Control

Rent can be credited to NRO and remitted as current income after tax compliance.

Practical example

An NRI rents a flat for ₹80,000 a month. The tenant deducts tax under the resident rent provision because the landlord’s Indian PAN looks normal. The wrong section can create tenant default and credit mismatch. Residence must be communicated in writing.

How to apply the framework

Provide the tenant a tax-status letter and lower-deduction certificate if obtained. Reconcile monthly gross rent, TDS, NRO credit and Form 26AS/AIS.

Keep municipal tax and loan-interest records. If the property is co-owned, allocate rent and TDS consistently.

Decision workflow

Before the transaction

Write down the person’s Income-tax residence and FEMA residence separately. Identify the source and beneficial owner of the money, the exact transaction purpose, the account or remittance route and the Indian and foreign reporting consequences. Do not rely on a bank product label or a platform dropdown as the legal conclusion. For a material amount, obtain the authorised dealer’s document list and professional tax or FEMA advice before signing the contract or sending money.

After the transaction

Reconcile the bank debit or credit to the contract, invoice, deed, grant statement or investment record. Store the exchange rate, purpose code, TDS/TCS, foreign tax and closing ownership. The annual tax file should connect the transaction with the relevant ITR head, Schedule FA/FSI/TR where applicable and Form 67 or Form 15CA/15CB when required. A cross-border transaction is incomplete until the money trail and reporting trail agree.

Annual review

Review status, accounts and foreign assets after departure, return, job change, property sale, inheritance, major gift or new overseas investment. Update nominees, powers, beneficial ownership and contact details. Preserve documents for longer than an ordinary domestic expense because foreign-asset, capital-gain and source-of-funds questions can arise years later.
