LLP tax return preparation should not start from a tax utility. It should start from books, partner accounts, Form 8/Form 11 data, audit status and statutory reconciliations.

2-minute answer: An LLP’s entire profit is taxed at a FLAT 30% (plus applicable surcharge and cess) - there is no slab benefit and no presumptive-taxation option (LLPs are explicitly excluded from Section 44AD). A tax audit under Section 44AB is triggered separately from the LLP Act audit - business turnover above ₹1 crore (₹10 crore if at least 95% of receipts AND payments are digital) or professional receipts above ₹50 lakh trigger the INCOME-TAX audit; the LLP Act statutory audit under Rule 24 of the LLP Rules, 2009 uses a completely different trigger - contribution exceeding ₹25 lakh OR turnover exceeding ₹40 lakh in any financial year. An LLP can be well below the tax-audit threshold and still require an LLP Act audit, or vice versa - checking only one is a common filing gap.

Partner Remuneration: The Section 40(b) Trap

Working-partner remuneration and interest on partner capital are NOT automatically fully deductible against LLP profit - Section 40(b) caps both. Interest on partner capital is deductible only up to 12% per annum, and remuneration to working partners is deductible only within slabs tied to the LLP’s book profit (a higher percentage on the first slice of book profit, a lower percentage above it). Remuneration must also be AUTHORISED by the LLP agreement and quantified (not open-ended) to be deductible at all - a common working-file gap is partners drawing remuneration that exceeds what the agreement and Section 40(b) slabs actually permit, with the excess disallowed in the tax computation rather than simply taxed as partner income.
