Most GST orders — a demand, a registration cancellation, a refund rejection — can be challenged before the jurisdictional Appellate Authority. The process is entirely electronic, but the filing window is short and the pre-deposit is mandatory, not optional. Here is the actual sequence.

Who can file, and against what

Under Section 107 of the CGST Act, any person aggrieved by a decision or order passed by an adjudicating authority — a demand order, cancellation of registration, rejection of a refund claim, or a similar order — can appeal to the jurisdictional Appellate Authority. This is a departmental officer (usually of Joint Commissioner or Additional Commissioner rank) designated for the purpose, not a court or tribunal.

Orders that are purely procedural in nature — for example, an order transferring proceedings between officers — are generally not appealable. The appeal must be against a substantive decision affecting liability, refund, or registration status.

The time limit — and why it is stricter than it looks

The clock starts from communication of the order, not from when the taxpayer happens to read it — for orders uploaded to the GST portal, this is typically treated as the date of upload/communication, so checking the portal regularly matters more than waiting for a physical copy.

Filing Form GST APL-01

  1. Log in to the GST portal and navigate to Services → User Services → My Applications, or directly to the appeals module against the specific order.
  2. Fill Form GST APL-01 — grounds of appeal, relief sought, and a statement of facts.
  3. Upload supporting documents: the order being appealed, relevant invoices/returns, and any correspondence relevant to the grounds raised.
  4. Pay the mandatory pre-deposit (see below) — the appeal is not considered filed until this is paid.
  5. On submission, a Final Acknowledgement (Form GST APL-02) is generated with an Appeal Reference Number (ARN) once the pre-deposit is confirmed.
⚠ Common filing mistake: Submitting APL-01 without completing the pre-deposit payment leaves the appeal in a provisional/incomplete state — it does not stop recovery proceedings and does not count as "filed" for limitation purposes until the deposit clears.

What happens after filing

The Appellate Authority is required to give the appellant a reasonable opportunity of hearing where an adverse decision is contemplated, and — where practicable — decide the appeal within one year of filing, though this is a directory (not strictly enforced) timeline in practice. The Authority can confirm, modify, or annul the order under appeal, but generally cannot refer the matter back for fresh adjudication except in limited circumstances, and cannot enhance the demand without giving the appellant an opportunity to show cause against the enhancement.

Frequently Asked Questions

Does filing a GST appeal automatically stop recovery of the disputed amount?
Recovery of the balance disputed amount (beyond the pre-deposit already paid) is treated as stayed once the appeal is validly filed with the pre-deposit — the department cannot pursue recovery of that balance while the appeal is pending. The pre-deposit itself, however, is a precondition to this protection, not something recovered separately.
Can I appeal if I missed the 4-month outer limit (3 months plus condonation)?
There is generally no statutory appeal route left under Section 107 after the outer limit lapses. Some taxpayers have approached High Courts under writ jurisdiction in genuine hardship cases, but outcomes vary by court and are not a reliable substitute for filing within time.
Is a personal hearing mandatory before the Appellate Authority decides?
A hearing must be granted if the Authority intends to pass an order adverse to the appellant, and generally three adjournments are permitted at most before the matter proceeds on available record.
