Introduction
The Supreme Court's landmark ruling in November 2022 — directing EPFO to allow eligible employees to opt for higher pension under EPS-95 on actual (higher) salaries rather than the ₹15,000 wage cap — triggered one of the most complex pension compliance exercises India's HR departments have faced.
EPFO set multiple application deadlines, extended them several times, and has now processed a significant portion of applications. However, thousands of applications remain stuck — pending employer validation, salary verification, or EPFO processing backlogs.
If you applied and haven't heard back, here's exactly what the current status is and what you can do.

Background — What The Higher Pension Option Means
Under EPS-95, pension contribution is 8.33% of wages — historically capped at ₹15,000 (so maximum EPS contribution is ₹1,250/month). Many employees earning ₹50,000 or more per month were contributing EPS on only ₹15,000.
The SC ruling allowed these employees to contribute EPS on their actual wage — meaning a much higher pension at retirement. The cost: both employee and employer must pay the differential contribution (plus interest) for the period they were contributing on capped wages.

Current Status — May 2026
Application window: Most categories closed; processing of already-filed applications continues. Check your status on EPFO unified portal before assuming ineligibility.
Processing status: EPFO has processed applications in batches. However:
New applications: Not accepted — the window is closed for fresh higher pension applications.

If Your Application Is Pending — Actions To Take
Step 1: Check status on EPFO unified portal Login at unifiedportal-mem.epfindia.gov.in → Services → "Track application for validation of Joint Option"
Step 2: If status shows "Employer validation pending" Follow up with your employer's HR/PF department immediately. Employer must log into EPFO employer portal and validate your joint option application.
Step 3: If status shows "Under scrutiny at EPFO" EPFO is calculating the differential contribution demand. Wait for the demand notice (DRC-05 equivalent).
Step 4: When differential demand is received Calculate whether the higher pension benefit justifies the upfront differential payment:
Step 5: If application is wrongly rejected File a representation to the Regional PF Commissioner → then to EPFO headquarters → then approach High Court if needed.

Practical Calculation Example
Parameter Example
Employee age 45 years
Actual monthly wage ₹60,000
Years of service 20
Additional years to retirement (60) 15
EPS on ₹60,000 (8.33%) ₹4,998/month
EPS on ₹15,000 (current) ₹1,250/month
Monthly pension uplift (illustrative) ₹8,000–12,000/month
Differential contribution demand (approx) ₹15–25 lakh (with interest)
Break-even period at retirement 15–25 months of higher pension
For most employees 45+, the higher pension option is financially favourable if differential demand is reasonable.
