What an inoperative PAN actually costs you

If your PAN has not been linked to Aadhaar by the applicable deadline, it becomes inoperative. For TDS and TCS purposes, an inoperative PAN is treated exactly as if you had not furnished a PAN at all — which triggers the higher rates under Sections 206AA and 206CC instead of the normal rate. This reaches salary TDS, TDS on interest, professional fees, rent, and virtually any payment subject to TDS or TCS. It can also create difficulties at multiple stages of ITR filing and processing.

If you deduct TDS from others — vendor and landlord controls

If you are the one deducting tax — paying rent, onboarding a vendor, or paying a professional or contractor — an inoperative PAN on the other side is your risk, not just theirs.

Frequently asked questions

If my PAN becomes operative again, do I get back the extra TDS?

Yes. The higher TDS deducted while your PAN was inoperative remains a valid credit attached to your PAN — it shows up in Form 26AS/AIS once the deductor files their TDS return. Once your PAN is operative again, claim it in your ITR as usual; any excess over your actual liability is refundable.

Does an inoperative PAN affect anything beyond income tax?

Linking Aadhaar (with the applicable fee if you are linking after the original deadline) generally restores your PAN, but not instantly — there is a processing period during which it remains inoperative. Recheck your status on the official portal after linking rather than assuming it is immediate.
