Advisory checklist
Scope
Identify the person, transaction, system, market or jurisdiction and the date on which the law is being applied.
Authority
Confirm the regulator/Registrar/exchange/tribunal and any delegation or authorisation.
Operative law
Use the current Act plus the exact rules, regulations, directions, notifications and operating documents that apply.
Proof
Retain orders, filings, acknowledgements, registers, system records and calculations needed to reproduce the conclusion.
Common mistakes
- Using an old circular when a consolidated direction or amended rule now governs.
- Assuming a section heading gives the complete rule without checking subsections, provisos and explanations.
- Using another regulator’s or another State’s form without checking jurisdiction and enabling law.
- Calculating a timeline from an internal processing date instead of the statutory trigger.
