Identify the actual section 9-14 instrument; an enabling section alone is not an automatic subsidy, loan or procurement award.

Rules, conditions and exceptions
- Section9 enables Central Government notifications for skills, technology, marketing, infrastructure/cluster development and other measures promoting competitiveness, particularly of micro and small enterprises. A programme’s specific eligibility and sanction arise from its actual instrument, not from a generic MSME certificate alone.
- Section10 requires progressive credit policies/practices specified through RBI guidelines or instructions to support timely/smooth credit and competitiveness. It does not itself sanction a named loan or make every applicant’s demanded loan amount payable by a bank.
- Section11 enables the Central or State Government to notify procurement preference policies for goods/services produced/provided by micro and small enterprises, for the listed ministries/departments, aided institutions and public sector enterprises. The text is not a blanket preference requirement imposed on every private buyer or every medium enterprise.
- The precise procurement percentage, sub-target, exemption or tender procedure comes from the applicable notified policy/order. Section11 itself does not print a universal percentage. Establish which buyer and instrument govern before claiming a bid preference or purchase entitlement.
- Section12 constitutes notified funds credited with Central Government grants under section 13. Section13 requires parliamentary appropriation before the grants are credited. The existence of an enabling fund provision is not a release order to an applicant.
- Under section 14, the Central Government administers the funds in the prescribed manner; utilisation is confined to the specified section 9 promotion measures, with coordination/timely release according to prescribed criteria. Institutional fund administration is separate from an enterprise’s own bank balance.
- For a claimed benefit, retain the programme/order identifier, eligible category, application, sanction, conditions and actual disbursement. A Board recommendation, a loan application and a bank credit are three different evidential stages.

Worked example
A small manufacturer bids for supplies to an eligible public-sector buyer. It identifies the actual notified procurement policy and tender conditions rather than treating section 11 as an automatic purchase order. A separate bank loan request is assessed under the applicable RBI/bank process and is not sanctioned by the tender preference alone.
Questions answered
Does section 11 itself guarantee a purchase order?
No. It enables notified procurement-preference policies; the actual policy, tender and eligibility govern.
Does the section 11 text cover every private buyer and every medium enterprise?
No. Its specified public-buyer and micro/small-enterprise scope must be respected.
Is a section 12 fund the same as an applicant’s released subsidy?
No. Constitution/appropriation/administration and an individual sanctioned disbursement are separate stages.
