Provision-wise commencement gate
Do not infer that every provision of the Mediation Act, 2023 is operative merely because India Code displays an Act-level enforcement date. The commencement notification is provision-specific. Before stating a present legal duty for Chapter IX (sections 40–42), verify that the relevant section has actually been brought into force by notification and check any later rules/regulations.
- Separate enacted text from commenced/operative text.
- Do not treat a private mediation centre as a statutorily recognised “mediation service provider” unless the operative recognition framework and facts support that status.
- Existing court-annexed mediation, Legal Services Authorities and contractual/institutional arrangements may continue under their own legal basis; describe that basis precisely.
- Record the notification/rule date beside any current recognition, registration or institutional requirement.
