Case-Law and Enforcement Register

How to track IFSCA enforcement orders, circulars and SAT appellate decisions relevant to an IFSC entity.

Where IFSCA publishes enforcement action

IFSCA publishes orders, circulars and press releases on its own website under its enforcement/legal-framework sections — unlike SEBI/RBI, the volume of published enforcement orders is still comparatively small given IFSCA's shorter operating history (constituted 2020), so a register needs to be actively rechecked rather than assumed stable.

SAT appellate decisions

Appeals from IFSCA orders go to the Securities Appellate Tribunal (Section 27) — SAT's own published orders are the primary source for how an IFSCA enforcement position has fared on appeal, and should be read alongside the underlying IFSCA order rather than in isolation.

Practical monitoring approach

Given the relatively young and fast-evolving regulation-by-regulation approach IFSCA has taken since 2020, an entity's compliance function should track circulars and FAQs issued under its own specific activity regulation (Fund Management, Banking, etc.) as closely as the parent Act — much of the operative detail investors and counterparties actually rely on sits in circulars, not the Act or even the regulations themselves.
