Where an adult family member manages joint-family property, section 12 ordinarily prevents appointment of a guardian specifically for the minor undivided interest.

How this provision works
- The High Court jurisdiction to appoint a guardian for that interest is expressly preserved. This is a specific property situation, rather than an exemption for every separately owned asset.
- Section 13, the next provision in the Act, makes welfare paramount in court appointment or declaration of a guardian. No person is entitled under the Act or guardianship-in-marriage law if the court finds that guardianship would not serve the minor welfare.
Questions answered
Does the statutory order of relatives override the child welfare in court?
No. Section 13 makes welfare paramount and limits an otherwise claimed entitlement.
