Mortgage litigation workflow
- Prove the security
Compile mortgage instrument, title, registration, consideration and property schedule. - Join interests
Search encumbrances and add persons whose rights are affected, subject to the rules. - Settle accounts
Reconcile principal, lawful interest, payments, costs, rents and receipts. - Draft decree stages
Use the applicable Appendix D form with case-specific and local-rule variations.
Examples and highlighted points
Example: A bank seeks sale on an English mortgage but omits a later mortgagee shown in the registration search. The court cannot safely order a clean priority distribution without addressing the encumbrancer's rights. The title and charge search should be refreshed near decree and sale.
Accounts case: The mortgagee has been in possession and collected rent. The redemption account is not simply principal plus contractual interest; receipts, authorised expenses and the mortgagee-in-possession duties must be brought into the court's accounting directions.
Do not confuse remedies
Foreclosure and sale are not interchangeable labels. Identify the mortgage type, transfer instrument, applicable special statute and relief legally available.
Special-law overlay
Banking recovery statutes, insolvency law, limitation and State land rules may affect forum or remedy. Record why the CPC mortgage-suit route remains applicable.
Q&A and official source
Does a preliminary decree end the suit? Ordinarily no; further rights and a final decree may remain. Can the court extend the payment time? Apply the relevant rule and order; do not assume an automatic extension. Must the prescribed form be copied word for word? Order XLVIII permits necessary variations, but the form cannot replace required findings.
