Order VI: Pleadings generally

The CPC framework for material facts, particulars, signing and verification, striking out and amendment of pleadings.

A pleading states material facts, not the evidence by which those facts will be proved. Order VI works with the plaint and written-statement rules, court and High Court amendments, commercial-dispute verification requirements and the law of limitation.

Rule-by-rule working map

Drafting workflow

  1. Build issues
List each cause of action or defence and its legal ingredients.
  2. Map facts
Attach a pleaded fact, date and party to every ingredient without pleading the proof.
  3. Check particulars
Add the heightened detail required for fraud and similar allegations.
  4. Verify and file
Confirm authority, verification basis, form, annexures and court-specific rules.

Practical and advisory cases

Example: A plaintiff alleges that a director "fraudulently diverted funds" but gives no transaction, date, amount or representation. Repeating the adjective does not meet Rule 4. Plead the material acts and particulars that define the alleged fraud, while leaving witness testimony and bank proof for evidence.

Amendment case: After evidence begins, a party discovers a new contractual theory from documents already in its possession. The court must consider the Rule 17 proviso and due diligence, the nature of the change, prejudice and limitation. Calling the amendment clarificatory does not answer those questions.

Q&A and official source

Must every document be quoted? Normally plead its effect so far as material, unless exact words are material. Can verification be delegated casually? No; record authority and the basis of knowledge. Does permission to amend decide limitation? Not automatically; limitation and relation-back issues remain for reasoned determination.
