Checklist progress

1. WHAT TO DO FIRST

Preserve original communication and all attachments. Verify authenticity through the issuing portal/authority; record actual service date and time. Identify issuer, entity, period, precise statutory section, nature of communication, applicable Act and whether it is only an information request or a formal assessment, show-cause, demand, hearing, recovery, adjudication or appeal. Never assume all notices have the same deadline.

2. WHICH NOTICE HAVE YOU RECEIVED?

GST: scrutiny, mismatch, ASMT, DRC, SCN, order, interest/penalty, refund, audit, summons, appeals. Check tax period because sections 73/74 vs 74A depend on statutory transition.

Income tax: automated mismatch, e-Proceedings, scrutiny, reassessment, demand, penalty, TDS/TCS, appeal, refund adjustment. Tax year and historic assessment year determine whether the Income-tax Act, 2025 or legacy 1961 Act applies.

MCA/ROC: filing defaults, director/secretarial, beneficial ownership, related parties, adjudication or inspection.

RBI/SEBI/FEMA/IFSCA: entity's regulated status, direction/order, regulatory power, underlying license and appellate forum.

Labour/state authority: establishment, wages, contractor, safety, social security, inspections or employee disputes.

3. AUTHENTICATE AND EVIDENCE SERVICE

Verify official portal, DIN/reference where prescribed, source email or physical delivery and authority designation. Download digitally signed PDF and annexures, never trust only SMS or a screenshot, verify entity PAN/GSTIN/CIN. Preserve original file hash, upload timestamp, acknowledgment and served-on person. Escalate suspected phishing to the authority through separately verified channels.

4. CALCULATE RESPONSE AND APPEAL DATES

Prepare deadline matrix: (a) event or communication issue date; (b) service date under actual law; (c) period to file reply; (d) hearing; (e) order due date; (f) appeal/rectification; (g) recovery/stay. Annotate source: applicable section, rule, notice and portal instructions. Treat the nearest claimed deadline as urgent pending verification. Explain late filing and condonation separately where law permits. Never put a generic 30-day appeal deadline on all regulator pages.

5. BUILD THE ALLEGATION-WISE RESPONSE

Extract each allegation and legal basis; identify amounts, periods, facts disputed, transaction source, booked/declared position and supporting documents. Reconcile return→books→bank→source invoices. Independently compute tax/duty/interest/penalty and separate procedural objections from merits. Identify any undisputed liability requiring separate payment action. Evidence index fields: ID, exhibit name, period, claim supported, original source, file hash and authenticity verifier.

7. FILE IN THE CORRECT CHANNEL

GST: use applicable GST portal response/appeal form and check form-specific proof, attachments and ARN. Income tax: e-Proceedings or appeal workflow as appropriate; file exact tax-year response, verify upload success. MCA: designated portal or adjudication submission. SEBI/RBI/FEMA/labour: document-specific online or prescribed physical channel. Archive submitted form, exhibits, digital acknowledgments and final downloaded PDF. A 'saved draft' is not filing.

8. HEARING, ORDER AND APPEAL

Before hearing: authorisation, short chronology, computation issues and indexed submissions. During hearing: record attendance and additional-document requests. On order: reconcile operative directions, confirm valid service, identify rectification/review/appeal period, pre-deposit and stay only for the relevant law; update exposure and payment/recovery calendar. Record whether appellate forum is departmental, tribunal, court or specialised regulator. No blanket success-rate estimates.

9. TAX, FINANCIAL, ACCOUNTING AND CASH-FLOW IMPACT

Exposure model: disputed principal tax/fee, separate time-specific interest, potential statutory penalty, professional/adjudication expenses, non-cash operating burden, refund/recovery timing and possible stay or deposit requirements. Accounting recognition depends on applicable accounting standard and probability/measurement, not automatically the full alleged amount. Example: ₹10 lakh disputed principal should not be presented as a certain ₹10 lakh current tax liability plus an invented fixed penalty. Build legal high/base/low scenarios with expert-reviewed values and evidence; stress liquidity and operational risk.

10. SAMPLE RESPONSE STRUCTURE

Heading: issuing authority/notice number/section/period; subject. Paragraph 1: acknowledgment, representation details, scope. Paragraph 2: factual background and chronology. Table: allegation number → claimed basis → factual response → operative section/circular/judgment → exhibit → amount. Paragraph 3: legal grounds. Paragraph 4: request for correction/withdrawal/hearing/information. Signature and verification. Annexure list, index, exhibits and submission proof. Do not send unsupported admissions or client-confidential third-party data beyond what is legally required.

11. CONTROL REGISTER AND ONGOING REMEDIATION

Maintain central tracker: notice ID, recipient, authority, fiscal period, statutory provision, received/service dates, response deadline, hearing, status, case owner, counsel, reviewed amount, action, filed acknowledgement, order, appeal deadline, deposit, control remediation and closure evidence. Weekly pending-review huddle; urgent alert for deadlines. After resolution fix upstream filing errors, reconciliations, vendor controls, statutory interpretations and disclosure process. Archive entire decision file.

12. QUESTIONS READERS ASK

Is a portal intimation a demand? Not always: classify the actual instrument.

Can I reply after the date? Applicable law/portal may permit extension or condonation, not automatically.

Should I pay the amount to avoid penalty? Evaluate merits, statutory interest/penalty and contest/appeal options with adviser.

How to reply to GST notice? Use the notice-specific official module and prescribed form, not a universal template.

What if an order is already passed? Calculate correct appeal/rectification/stay timelines immediately.

Is a DIN missing? Determine whether DIN is prescribed for that communication and whether a valid exception applies.
