Valuer name removal and restoration. 249. (1) The relevant Chief Commissioner-level or Director General-level authority may, after a hearing and any inquiry considered necessary, remove a valuer's name from the register where it was entered by error, misrepresentation, or suppression of material fact, or where the valuer has been convicted and imprisoned or found guilty of professional malpractice or misconduct rendering him unfit to remain registered. (2) That authority may, on application and sufficient cause shown, restore a removed name to the register. (3) The authority shall, once every five years, review all registered valuers' performance and may remove any valuer's name (after a hearing and any necessary inquiry) where performance warrants it. (4) The authority may conduct such an inquiry itself, or appoint an Inquiry Officer (not below Joint Commissioner rank) who, together with the authority, has the same powers as a civil court under the Bharatiya Nyaya Sanhita, 2023 in respect of discovery and inspection, compelling attendance and examination on oath (including of a banking company officer), compelling production of books and documents, and issuing commissions.
