Interest receipt certificate application. 209. (1) A person entitled to receive interest or another sum of the nature specified in section 393(2) [Table: Sl. No. 17] may apply in Form No. 126 for a certificate under section 395(1) authorising receipt of such income without deduction of tax. This includes: a banking company or insurer (as defined in section 2(9)(d) of the Insurance Act, 1938) that is not a domestic company and operates in India through a branch, provided it has been regularly assessed and has filed returns for the last five tax years due before the application, is not in default on any tax or related sum, and the interest or sum is receivable by the branch for its own account and not on behalf of its head office, an overseas branch, or another person - in which case the certificate covers any interest (other than interest on the specified excluded category of securities) or any other sum other than dividends; and any other person carrying on business or profession in India through a branch, meeting the same conditions plus at least five years of continuous business or professional activity in India and fixed assets in India (per the relevant tax year's books) exceeding Rs 50 lakh - in which case the certificate covers any sum other than interest or dividends. (2) The certificate granted by the Assessing Officer under section 395(1) shall be valid for the tax year specified therein, unless cancelled by him before the expiry of that tax year. (3) An application for a fresh certificate may be made, if required, after the expiry of the earlier certificate's validity, or within three months before its expiry.
