Time and manner in which persons referred to in rule 159 shall furnish a statement containing particulars of Form No. 97. 160. (1) Every person referred to in sub-rule (2), who has received a declaration in Form No. 97 in relation to a transaction specified in the Table in rule 159, shall furnish a statement in Form No. 98 to the Director or Joint Director of Income-tax (Intelligence and Criminal Investigation) through online electronic data transmission and obtain an acknowledgement number, and shall retain Form No. 97 for six years from the end of the financial year in which the transaction took place. (2) This obligation applies to the persons specified against serial numbers 11, 12, 13 and 14 in column 4 of the Table in rule 159, and to those specified against serial numbers 15 or 16 who are required to have their accounts audited under section 58. (3) The statement shall be furnished, for declarations received up to 30 September, by 31 October of that financial year; and for declarations received up to 31 March, by 30 April of the following financial year. (4) The statement shall be verified, where the furnishing person is an assessee, by the person specified in section 265; and otherwise, by the person specified in column 4 of the Table in rule 159.
