Current law and effective date

Section 166 is controlled against the consolidated Income-tax Act, 2025 as amended by the Finance Act, 2026. The Act and Income-tax Rules, 2026 operate from 1 April 2026; earlier years and saved proceedings require the repeal-and-savings framework rather than automatic migration.

2-minute decode

A TPO proceeding is evidence-driven. The officer determines the arm's length price, while the Assessing Officer computes total income in conformity with that determination.

Who should use this section

Assessing Officers, Transfer Pricing Officers and taxpayers dealing with a TP reference, unreported covered transactions or a valid multi-year option.

Old-law bridge

section 92CA

The old-law bridge is navigational, not automatic precedent transfer. Match the 1961 Act wording, saved proceedings, current 2025 Act text and effective date before importing an older interpretation.

Finance Act 2026 / current-law note

Finance Act, 2026 substituted the TPO-order limitation rule. The current deadline is tied to one month before the month in which the assessment limitation expires, with special 31 March and 31 December end-date mechanics reflected in the operative text.

Professional alert

Application caution The multiple-year option is procedural, transaction-specific and unavailable for proceedings under Chapter XVI-B.

Worked application

A taxpayer reports software services but omits a group guarantee. If the guarantee comes to the TPO's notice, it can be treated as referred without a separate original reference.

Evidence / compliance checklist

  • Form 46 option (section 166 evidence control 1).
  • transaction similarity analysis (section 166 evidence control 2).
  • TPO notices and replies (section 166 evidence control 3).
  • complete accountant report reconciliation (section 166 evidence control 4).

Common mistake

A common section 166 error is to apply the old-law label or headline rate without rebuilding the current statutory conditions. For “Reference to Transfer Pricing Officer”, the safer control is to test the exact taxpayer/transaction facts, the operative tax year, every linked Rule/Form and the Finance Act 2026 consolidated wording. Application caution The multiple-year option is procedural, transaction-specific and unavailable for proceedings under Chapter XVI-B.

Recommended approach

For section 166, start with the legal trigger in “Reference to Transfer Pricing Officer”, document the evidence for that trigger, then run the computation or procedural step against the current text. As a cross-check, verify this provision-specific checkpoint: A valid multi-year option can extend a qualifying arm's-length determination to the next two consecutive tax years, subject to prescribed conditions.

The Assessing Officer may refer an international or specified domestic transaction to the Transfer Pricing Officer with prior approval of the Principal Commissioner or Commissioner. The Transfer Pricing Officer can examine another covered transaction noticed during the proceeding, including one omitted from the accountant's report. For qualifying similar transactions, a valid option can extend the arm's length determination to the next two consecutive tax years, subject to prescribed form, timing and conditions.

FAQs

Does an old Income-tax Act, 1961 case automatically decide section 166?

No. The old-law bridge helps research, but transferability depends on materially matching language, transition rules and any Finance Act 2026 change.

Which text should be quoted in advice or litigation?

Quote the consolidated official statute for the relevant tax year. If this page presents a provision summary rather than complete statutory text, use the official consolidated Act for verbatim legislative language.
