Section 101 - Total income
Section 101 is an aggregation rule, not an exemption. It ensures that a member's share governed by Chapter XVII, Part A, sub-part 4 (association of persons and body of individuals) is brought into the total-income computation wherever that sub-part requires inclusion, even though income-tax may not be payable again by the member. The detailed treatment sits mainly in sections 309-311.

Professional alert
Professional alert Do not confuse an item included in total income but not taxed again with an item excluded from total income under Chapter III. The return, disclosure, rate and loss consequences can differ.
Connected Income-tax Rules, 2026 and Forms
No provision-specific Rule/Form is independently mapped in this tranche. General return, procedure and evidence rules can still apply.
Worked application
An association of persons is taxed on its income and a member receives a computed share. Depending on section 310, that share may form part of the member's total income while no further income-tax is payable on it. Section 101 prevents the computation from treating “no tax payable” as “not included at all”.
Evidence / compliance checklist
- For section 101, retain the transaction and computation documents that prove each statutory condition.
- Reconcile the claim to the return and primary-source text for the relevant tax year (section 101: Total income).
- Preserve any linked Rule/Form evidence and approval or certificate required by the provision (section 101: Total income).
Common mistake
Applying section 101 from its heading alone without reconciling every operative condition and exception.
Recommended approach
For section 101, fix the governing tax year, identify the operative sub-section for “Total income”, trace every amount to evidence, apply only verified Rule/Form links, and retain a computation that another reviewer can reproduce from the primary source.
Thresholds, periods and timing checkpoints
No standalone numeric threshold is extracted from the section text; apply the operative conditions and linked provisions.
Judicial / interpretive bridge
No section-specific Supreme Court bridge is included for section 101 unless text-equivalence with the 2025 Act has been checked. Legacy cases should not be transplanted into section 101 merely because the subject is similar.
