How RERA Gazette instruments and regulator orders fit together — operative law and practical guidance

The central RERA Act is not the complete filing manual. State/UT rules issued under section 84 and Authority regulations under section 85 prescribe many practical requirements. These should be cited by name, issuing authority, instrument number, date, territorial scope, effective clause and any explicit supersession or temporary extension. A website news item is only a locator to the actual signed order.

Exceptions, state rules and legal consequences

UP RERA listed September 2026 directions on digital REG-1, REG-2 and REG-3 professional certificates for the September-quarter QPR and an October 2026 extension notice. MahaRERA published a detailed directions PDF concerning three project bank accounts and their transfers. Preserve both examples as state-specific evidence rather than merging their instructions into a purported national standard.

Practical application

A professional source register should distinguish Act, gazetted rule, circular, order, FAQ, technical filing guide and court ruling. The most recent website upload may be a correction to an earlier order; reconcile both before setting a due date or form obligation in a calculator.

Worked example

Example: the UP regulator website lists an extension notice dated 9 October 2026. A compliance calendar should record the date only after reading the notice’s actual revised deadline and project-class scope. The date of the notice is not necessarily the new filing due date.

How to prepare a compliant evidence trail

  1. Index instruments by authority and provision
  2. Capture signed PDF, instrument number and effective clause
  3. Mark amendments, withdrawals and transitional exceptions
  4. Validate quarterly calendar against the regulator’s actual filing screen

Common errors to avoid

  • Treating technical guidance as an Act amendment
  • Propagating UP instructions to Maharashtra
  • Publishing an extension without extracting its new date

Decision point and edge case

Maintain distinct dates for Gazette publication, legal commencement, portal upload and any extended operational deadline. The September 2026 UP certificate digitisation order, October filing extension and Maharashtra bank directions illustrate why one “issued on” column is inadequate. Record exact instrument number from the signed copy when available and avoid copying the website’s announcement date into the statutory deadline field.

Instrument register: minimum fields

For every direction, retain the original PDF title and number, issuing Authority, territorial and project-class reach, subject matter, Gazette or signed date, publication date, commencement date, superseded order and last-checked date. Preserve an HTML copy or screenshot of the official index as discovery evidence, but rely on the signed instrument for binding content. Where an extension is notified, record the old and revised deadlines alongside the class of projects to which the extension actually applies.

In a September 2026 quarter example, UP RERA’s notice feed contains a 30 September professional-certificate digitisation order, a 3 October technical guide and a 9 October extension announcement. These are distinct instruments: the guide describes portal operation, the September order concerns certificate obligations, and the extension must be read to determine any revised deadline. Do not assume they all have identical legal force, and do not turn a notice date into a due date.

Reader question

Does the newest circular always override all earlier law? No; legal hierarchy, exact scope and express supersession control.
