How the 2020 change tightened this

The Foreign Contribution (Regulation) Amendment Act, 2020 reduced this cap from the earlier 50% to 20% of the foreign contribution utilised in the financial year, a substantial tightening that requires organisations to allocate a materially higher proportion of foreign funds directly to programme activity than the pre-2020 regime required.

Why it matters

Because the 20% cap is measured against foreign contribution utilised (not received) in the year, an organisation needs to actively monitor its administrative-to-programme spending ratio through the year rather than discovering a breach only when preparing the annual return - exceeding the cap without prior government approval for a higher limit is a compliance failure, however reasonable the actual overhead spending might be in absolute terms.
