Legal position
Current consolidated rules incorporate amendments through 25 January 2021; Gazette text prevails over the e-Version.
Bare Rule / official legal text
The exact legal wording is controlled by the official Rules/Gazette source. Use the official source below for the verbatim text and amendment notes before filing, advising or litigating.
Rule-by-rule decode
1. Identify the trigger
Determine the precise statutory event that makes Rule 9 relevant—application, examination, registration, opposition, renewal, assignment, rectification, licence, evidence, hearing, appeal or another Registry step.
2. Map the enabling Act provision
Open the connected section of The Designs Act, 2000. A procedural Rule does not create a substantive entitlement beyond the Act and must be read consistently with the statute.
3. Confirm form, fee and schedule
Check the current prescribed form, applicant/entity category, class or claim count, electronic/physical filing mode and fee schedule. Do not use an old form or fee merely because it appeared in a prior filing.
4. Confirm time and service
Calculate the deadline from the correct legal trigger. Separately verify extension, condonation, restoration, hearing and service provisions rather than assuming that delay can be cured.
5. Preserve evidence
Retain the signed filing payload, supporting documents, authority/POA, affidavits or declarations, fee receipt, acknowledgement, service proof, journal/publication evidence and later office communications.
Practical workflow
- Open Rule 9 in the official current Rules source.
- Read all sub-rules, provisos, explanations, tables and referenced sections/forms.
- Map the action to the parent Act and any connected Rules.
- Check the current forms, fees and schedules in the Finin2min IP hub and official portal.
- Prepare a dated evidence checklist and deadline calculation.
- File through the current official channel and preserve acknowledgements.
- Track journal publication, objections, opposition, hearing, registration, renewal or appeal as applicable.
Practical example
A client reaches a step that appears to fall under Rule 9. The adviser should not rely on a previous matter file alone. The correct approach is to re-open the current Rule, identify the enabling section, verify the prescribed form/fee and current portal route, document the trigger date, complete the evidence set and record proof of submission and service.
Exam / advisory case study
Issue: the client has the substantive IP right but may have missed or incompletely performed a procedural step. Method: distinguish substantive entitlement from procedural compliance; identify whether the Rules permit cure, extension, restoration, review, hearing or another remedy; then state the exact official source and evidence required. Do not assume that a discretionary remedy is automatic.
Highlighted professional points
- Gazette/official statutory text controls over summaries.
- Forms and fees are date-sensitive and should be rechecked before payment or filing.
- A right to apply is not the same as a right to obtain relief where discretion is involved.
- Maintain a chronology for opposition, rectification, renewal, hearing and appeal matters.
- Check electronic filing instructions and Registry notices in addition to the Rule itself.
Finin2min Q&A
What source controls if there is any difference?
The applicable Gazette and official statutory text control. Registry portal instructions govern filing mechanics only to the extent consistent with law.
Should an old form or fee be reused?
No. Recheck the current form and fee schedule on the filing date.
