Returns, payment, refund and other machinery substantially ride on the CGST/IGST framework as applied by the Compensation Act, together with cess-specific notifications and the Period of Levy and Collection of Cess Rules, 2022.

Practical control

  • Start with the charging Act, then identify the machinery provision it imports.
  • Apply the corresponding CGST Rule only to the extent the parent Act imports it and with necessary modifications.
  • Keep cess/rate notifications separate from procedural Rules.

Scope note

The Compensation Cess Act does not build a parallel return/payment/refund machinery of its own — sections 9 and 11 apply the CGST/IGST procedural framework to cess with necessary modifications, so a cess-specific question should first be checked against the Compensation Act and its own notifications (rate, exemption and the Period of Levy and Collection of Cess Rules, 2022) before falling back on the borrowed CGST machinery for the procedural mechanics.
