Recital and provisional-release request

The ten ASTER-EM1 modules were seized under section 67(2) in the stated order. On the obligor’s request, provisional release is assumed to have been permitted upon a bond equal to goods value and the separately calculated bank guarantee. No permission letter or guarantee is simulated by this model.

Production and payment conditions

The obligor undertakes to produce the provisionally released goods whenever required by the duly authorised proper officer. If the lawfully demanded tax, interest, penalty, fine and other charges are paid within ten days of a written demand, the obligation becomes void; otherwise it remains in force and the Government may enforce the bond/security according to its terms.

How this form moves the matter forward

  1. Match the bond to the seized goods and their value, and calculate security from the actual applicable tax, interest and penalty.
  2. Obtain an actual bank guarantee and execute the prescribed bond only after the competent provisional-release conditions are known.
  3. Produce the goods when required and track any written demand, discharge and formal security release.

Period and legal consequences

Rule 140 uses a goods-value bond and security equal to applicable tax, interest and penalty. It does not use the 25%-of-bond ceiling applicable to provisional assessment under rule 98. Although the historical bond recital says cash/bank guarantee, the operative rule requires bank-guarantee security.
