SEBI Recovery Certificate: Bank, Demat and Asset-Attachment Response File

A SEBI recovery certificate can be followed by demand, bank/demat attachment and remittance directions. The response file should reconcile the certificate, underlying order, amount, payments, ownership of attached assets and any lawful challenge or release request.

Start with the recovery chain
Collect the underlying SEBI order, recovery certificate number/date, notice of demand, attachment order and any general remittance order. Reconcile principal, penalty/interest/cost and payments already made.
A later attachment is easier to analyse when the original liability chronology is complete.
Asset ownership matters
For a joint bank/demat account, trust/HUF/company account or third-party holding, document beneficial/legal ownership and the exact account identifiers. Do not assume the attachment is invalid merely because another person is also named.
Any representation should identify the specific asset and legal basis for release/limitation.
Intermediary response controls
A bank or DP should log receipt time, account match, freeze/attachment action, exceptions, remittance and communication. Over-blocking the wrong account creates separate customer risk; under-blocking can breach the order.
Keep maker-checker approval for release after SEBI's instruction is satisfied or modified.
Attachment case: joint account includes an innocent co-holder
A recovery notice may reach a bank or DP account held jointly with another person. Neither the intermediary nor the co-holder should assume that joint status automatically defeats the attachment. The response needs the exact account mandate, ownership/funding evidence, recovery notice wording and legal basis for any requested exclusion or release.
The intermediary should implement the order as directed while escalating genuine ownership ambiguity through its legal/compliance process. The affected person should avoid informal withdrawals/transfers and use the formal representation route.

Reconciliation after remittance or release
After money is remitted or an attachment is lifted, reconcile the recovery ledger to SEBI's communication and the intermediary's account action. Equally, a partial payment should not be treated as full closure unless the recovery record confirms it.
