NCLT e-Inspection for Insolvency Case Records: Confidentiality and Document-Index Workflow

Insolvency case inspection should be organized by petition, IA, report, affidavit, order and hearing date, with a separate confidentiality flag for commercially sensitive or Bench-restricted material.

The case team should build an “official-record matrix” rather than a document dump. For each item, record who filed it, filing acknowledgement, defect status, IA number, page range, hearing where relied upon and whether it is visible in the NCLT record.

Structure the index

Separate main CP, admission documents, IRP/RP reports, CoC-related applications, avoidance/other IAs, claims-related pleadings and orders. Add confidentiality labels and access owner.

Reconcile before hearings

Compare the firm’s working bundle to Case History/e-Inspection. If a document is missing digitally, use filing receipts and registry follow-up; if an order is missing, trace the hearing/cause-list and order upload rather than citing an unofficial copy as final.

Protect restricted material

Do not circulate valuation, resolution-plan or other sensitive records merely because they are available to an entitled user. Keep download/access logs and apply the Bench’s directions and applicable insolvency confidentiality obligations.

Worked example

A resolution professional’s report is filed under a connected IA but the team index stores it only under the main CP. At hearing, counsel cannot locate the correct IA record. A structured index linking CP, IA, date, title, page range and confidentiality tag solves the retrieval problem and makes e-Inspection reconciliation faster.
