A borrower’s default does not create a licence for intimidation. RBI makes the regulated lender responsible for conduct of its outsourced recovery agents and places specific boundaries around harassment and calling hours. A good complaint therefore identifies the lender, agent, date, channel and exact conduct, instead of arguing only that recovery contact was unpleasant.

Screenshots, call logs, recordings lawfully retained by the borrower, WhatsApp messages and visitor details can turn a vague allegation into an auditable chronology.
When a field agent visits, ask for identification and the authorisation trail. Do not hand over cash merely because the visitor claims to represent the lender.
If internal grievance handling fails, the complaint file should contain the lender’s response or evidence that the prescribed response period has expired before RBI Ombudsman escalation.
Separate debt collection from unlawful pressure
The borrower may genuinely owe the money and still have a valid complaint about the manner of recovery. RBI’s 12 August 2022 instruction is aimed at conduct: intimidation, public humiliation, intrusion into the privacy of family or referees, threatening or anonymous calls, persistent calling, misleading representations and recovery calls before 8:00 a.m. or after 7:00 p.m. The liability question and the conduct question should therefore be documented separately.
A useful complaint is chronological. Record the lender, loan account, agent name or number, call timestamps, messages, home or workplace visits, statements made to third parties and the response of the lender’s grievance officer. If a third-party recovery agency is involved, the regulated bank or NBFC remains responsible for the outsourced activity; a complaint should not stop at the agency name.
Negotiating a settlement does not require surrendering basic safeguards. Before paying a field agent, verify the lender’s official payment channel and obtain written terms for any settlement or restructuring. Cash handed to an unauthorised visitor creates evidentiary and fraud problems even if the borrower was under pressure to pay immediately.

Over three days an agent calls 14 times, sends a message threatening a workplace visit, and calls the borrower’s brother at 7:30 p.m. The borrower should save the call log and messages, identify the bank/NBFC, submit a written grievance describing each event, and separately ask for the overdue computation. If the lender does not resolve an eligible service complaint through its internal mechanism, the borrower can use RBI CMS after satisfying the Ombudsman pre-conditions.
