Practical analysis

HUF partition has two very different meanings for tax: a genuine total partition can be recognised after the assessing authority is satisfied about the partition, while a partial partition has long faced special treatment under the Income-tax framework. A family memorandum alone does not automatically change the tax status of the HUF. The property, members and division must match the legal and tax facts.

For assets distributed on a recognised partition, the immediate movement should be distinguished from a later sale by the recipient. Cost and holding-period carryover rules can become relevant on the later transfer, so the family should preserve the HUF acquisition papers and partition allocation schedule. Without those records, capital-gain computation years later can become an evidence dispute.

Immovable property adds registration and title mechanics. Bank accounts, demat holdings, business interests and liabilities also need operational transfer. The family should reconcile the tax order/assessment position with the actual asset registers; otherwise an HUF can continue earning income in practice after the family believes it has been fully partitioned.

A total HUF partition should leave no unexplained residual pool. Property titles, bank balances, demat holdings, business interests, receivables and liabilities should all be mapped to members before the tax recognition process is treated as complete. The later capital-gain file is equally important: a member who receives an old HUF asset may need acquisition documents dating back well before the partition, so scanning the family settlement alone is not enough.

Worked examples

An HUF owns a house worth ₹80 lakh and securities worth ₹20 lakh. A claimed total partition must identify how the assets are physically or legally divided and be taken through the section-171 finding workflow where applicable. Treatment: A ₹1 crore family balance sheet does not itself demonstrate a recognised partition.

If only the securities are divided among members while the house remains HUF property, post-1978 section-171 treatment does not recognise that partial partition for the stated tax purpose. Treatment: Do not delete the HUF tax history merely because one asset was privately allocated.

Assume an HUF owns a house, listed shares and a fixed deposit. The family divides the house and shares but leaves the deposit and accrued interest in the HUF account. Calling the arrangement a “total partition” without addressing that residual asset can create a mismatch between the family document and tax facts. The asset schedule should identify every item and liability, the assessing-authority record should be preserved where required, and each recipient should receive the historical cost papers for the assets allocated to that person.
