A GST appeal should start with arithmetic. The admitted portion of the demand, disputed tax, disputed interest/penalty and the statutory pre-deposit are not interchangeable numbers. The appellant should reconcile the order to the appeal form and payment ledgers before pressing submit, because a defective amount mapping can block filing or weaken the record.

The pre-deposit base is disputed tax, not automatically the gross demand including interest and penalty. Special categories of orders can have different statutory conditions.

Electronic cash, credit and liability ledgers serve different functions; the legal and portal position should be checked before assuming any balance can satisfy pre-deposit.

The appeal statement should match the order number, tax period, demand breakup and grounds. A spreadsheet that reconciles these fields prevents accidental under- or overstatement.

Limitation runs from communication of the order, so proof of the date on which the order was made available or served should be preserved.

Where admitted liability exists, it should be identified separately; contesting one component does not suspend an amount the taxpayer itself accepts.

Payment references and appeal acknowledgement should be downloaded immediately and linked to the case file.

Pre-deposit is calculated on the disputed tax, not every line of the order

A first appeal under section 107 starts with two payment buckets: the amount the taxpayer admits, which must be paid, and the statutory pre-deposit linked to the disputed tax. Penalty and interest figures in the order should not automatically be multiplied by the same percentage unless the law specifically requires it for the appeal being filed.

The appeal file should reconcile the order, admitted/disputed split, electronic ledgers and APL-01 acknowledgement. GST rules/forms contemplate the pre-deposit being paid through the permitted ledger route; the taxpayer should retain the debit entry and final acknowledgement rather than relying on a screenshot of a provisional filing.

A weak ground of appeal can undermine an otherwise correct pre-deposit. Each disputed finding should be paired with the relevant invoice, return, reconciliation or legal argument so the appellate authority can see both the quantum and the factual reason for challenge.

Worked example 1

An order demands ₹8,00,000 tax, ₹1,60,000 interest and ₹80,000 penalty. The taxpayer admits ₹2,00,000 of the tax and disputes ₹6,00,000. The appeal working should first isolate the admitted amount, then calculate the statutory pre-deposit on the disputed-tax base under the provision applicable to that appeal. It should not mechanically apply the percentage to ₹10,40,000. The ledger/payment route and form fields are then matched to that calculation before filing.

Worked example 2

An order demands ₹8 lakh tax, ₹1.2 lakh interest and ₹80,000 penalty. The taxpayer accepts ₹2 lakh of the tax but disputes ₹6 lakh. The appeal working should separately show the admitted amount to be paid and the pre-deposit on the ₹6 lakh disputed tax, instead of applying 10% to the entire ₹10 lakh-plus order mechanically. The APL-01 grounds should then map the ₹6 lakh dispute to the underlying invoices and legal issue.

The standard section 107 formulation is linked to the disputed tax, after admitted amounts are paid; do not simply multiply the total order including interest and penalty.

Can ledger evidence matter in appeal filing?

Yes. Preserve the debit entry and portal acknowledgement showing how admitted amounts and pre-deposit were discharged.

What does “admitted amount” mean?

It is the portion of the liability the appellant is not contesting. That amount should be separated from the disputed tax in the appeal computation.

When is the appeal actually filed?

Follow the current portal/rule process and obtain the final acknowledgement/appeal number rather than relying on an incomplete draft or provisional status.
