A parent can fund a child’s education, but the bank trail should state whether the money pays an expense, is a gift or is a recoverable loan.

Practical example

Parents remit USD 40,000 to a child for tuition and living costs. The child invests unused funds in shares. The investment is the child’s asset only if the transfer was a genuine gift/support and the records support ownership; it should not be used as a proxy account for the parents.

Prepare an annual support letter and budget. Pay large tuition directly where practical, and document amounts placed in the child’s account.

Track refunds, scholarships and unused balance. The child’s foreign account may have Indian reporting consequences depending on the child’s residence and tax status.

Identify the person or entity, tax residence, FEMA residence, source of funds, beneficial owner, counterparty, purpose and the official form or bank route. Review purpose, remitter and beneficiary together. A bank account label, portal dropdown or adviser email should not be treated as the governing rule.

After acting

Reconcile the bank entry to the contract, form, asset or expense and preserve the official acknowledgement. Confirm that the same names, amounts, dates, currency and ownership appear in the tax return, FEMA report, demat or folio statement and financial statements where relevant. Correct discrepancies while the counterparty and bank can still reproduce the records.

At each year end, update the travel and residence memo, foreign-asset register, remittance register, tax-credit file and regulatory filing calendar. Review nominees, authorised signatories, tax IDs and portal access. A cross-border position should remain understandable to a successor professional without relying on the memory of the person who executed it.
