What the Official Instrument Says

Who Should Use This Guide

Exporters, importers, merchanting-trade businesses, CFOs, export finance teams, AD Category-I banks, trade-compliance teams, auditors and businesses with aged receivables/payables under FEMA.

Re-age open exports on the correct legal clock

An ERP ageing column may still show a contractual due date or an older regulatory assumption. The FEMA control file should separately hold shipment/export date, amount outstanding, buyer, AD bank, extension history, current regulatory deadline and follow-up status.

The move to a 9-month period makes aged-item review more time-sensitive. However, a historical transaction should not be reclassified mechanically without applying the commencement, savings and specific facts.

Where an exporter is on the carried-forward Caution List, the specific RBI order remains part of the operative evidence until the exporter is removed.

Legacy approval cases move closer to the AD bank

Regulation 20 is operationally important because it lets Authorised Dealers handle specified pre-1 October transactions that previously required RBI approval under the old framework. Exporters should route legacy cases with a complete chronology instead of sending an incomplete request based only on the old approval label.

The AD file should identify whether the case is export, import or merchanting trade, the old approval requirement, existing correspondence and why the matter falls within the new delegated handling power.

Finance, tax and audit reconciliation

FEMA realisation status does not automatically determine accounting impairment, GST export treatment or income-tax recognition. Those analyses should be reconciled, not collapsed into one conclusion.

A high-quality year-end file connects foreign-currency receivable ageing to bank realisation evidence, extension/AD decisions, EDPMS/IDPMS or other applicable system status and the accounting treatment adopted.

Practical Implementation Steps

  1. Extract every open export/import/merchanting item and tag whether it arose before or on/after 1 October 2026.
  2. Recalculate the relevant regulatory clock under the amended regulation and record any 12-month proviso condition separately.
  3. Flag Caution-List cases and preserve the specific order/history until removal is evidenced.
  4. For legacy matters that previously needed RBI approval, prepare a complete AD-bank submission with old correspondence and the new regulation 20 basis.
  5. Reconcile bank/system status to the general ledger and management ageing; assign owners for items approaching the regulatory deadline.

Worked Example

An exporter has an unpaid foreign receivable from an August 2026 shipment and had been preparing an RBI approval request under the earlier Master Direction. After 1 October, the team should not simply apply the new clock or discard the old file. It should establish the transaction’s legal vintage, examine regulation 20, give the AD bank the complete chronology, and document the AD’s decision while continuing accounting and collection review.

Common Mistakes

Frequently Asked Questions

Did every export period become nine months?

The amendment substitutes key periods in regulation 5, but a live conclusion still needs the transaction date, the exact clause/proviso, savings provisions and any specific RBI/AD order.

What happens to exporters already on the Caution List?

Those on the Caution List as at 30 September 2026 continue under the prior order until they are removed in accordance with the carried-forward provision.

Can the AD bank now handle old cases that earlier required RBI approval?

Regulation 20 delegates handling of specified pre-1 October export/import/merchanting transactions that had required RBI approval under the earlier framework; the facts and documentary trail still need to support the case.

What should be on the month-end dashboard?

Outstanding amount, transaction date, regulatory deadline, days remaining, AD-bank status, Caution-List/extension position and owner.
