AY 2026-27 ITR Filing: Why a Return Filed in 2026 Still Uses the 1961 Act

By CA Nikhil Gupta · 21 July 2026

The presence of the Income-tax Act, 2025 on the statute book does not mean every return filed after 1 April 2026 uses the new Act. The return for Assessment Year 2026-27 reports income of FY 2025-26, a period governed by the Income-tax Act, 1961. The official AY 2026-27 return material therefore continues to refer to the 1961 Act. Taxpayers who mix new-law section numbers into this return risk incorrect classification, unsupported disclosures and confusing workpapers.

Finin2min Summary

A return is a legal statement assembled from multiple systems that do not always agree. Form 16 can differ from AIS timing; broker reports can use a commercial gain method rather than the tax method; bank interest may be accrued differently; and foreign assets can require calendar-year or peak-balance data. Accuracy comes from reconciliation and documented judgement, not from importing every prefilled number.

Confirm form eligibility before preparing schedules

Start with status, residency, total income composition, directorships, unlisted shares, presumptive income, foreign assets, capital gains and brought-forward losses. Do not assume ITR-1 is appropriate merely because the taxpayer is salaried. Form eligibility conditions can exclude a taxpayer even when the return appears simple.

Reconcile information statements by source

Download AIS, TIS and Form 26AS, then map each item to salary records, bank certificates, broker contract notes, property documents, business books and tax challans. Separate genuine omission, duplicate reporting, timing difference and wrong third-party information. Preserve screenshots or acknowledgements of feedback submitted on incorrect entries.

Treat special assets as separate workstreams

For shares and securities, compute gains using tax holding periods, cost and corporate-action records. For VDAs, capture each disposal and TDS. For foreign assets and income, determine residency and the required disclosure period, and retain overseas statements. For immovable property, reconcile sale consideration, stamp-value provisions, improvement evidence and TDS.

Close with a filing control pack

The final pack should contain form-selection memo, tax computation, regime choice where relevant, advance/self-assessment tax reconciliation, AIS/26AS bridge, loss schedule, disclosure checklist, evidence index, reviewer sign-off and the filed acknowledgement. A portal success message is not evidence that the return's positions are substantively correct.

What the Viral Version Usually Misses

Two viral errors appear together: 'AIS is the tax return' and 'the new Act applies because the filing happens after 1 April 2026'. AIS can contain incomplete, duplicated or timing-different information, and AY 2026-27 still relates to the old-law income period. The correct process reconciles both the data source and the governing law.

Worked Scenario: A salaried investor with broker, VDA and overseas holdings

A resident employee has Form 16 salary, interest from three banks, equity and debt-fund sales, two crypto disposals and an overseas brokerage account. AIS misses one bank interest item and duplicates a security sale; the broker's gain report does not reflect one corporate action. The taxpayer should not copy the AIS total or force the case into a simple salary form. The filing file needs a transaction-level capital-gains computation, VDA schedule, foreign-asset review, corrected AIS feedback trail and a form-eligibility memo under the 1961 Act for AY 2026-27.

Practical Decision Checklist

Article-Specific Q&A

Does AY 2026-27 use the Income-tax Act, 2025?

No. It reports FY 2025-26 income and the official AY 2026-27 forms remain under the Income-tax Act, 1961 framework.

Is every AIS item automatically taxable?

No. AIS is an information statement. Taxability, ownership, duplication and timing must be tested against law and evidence.

What if Form 26AS and AIS show different tax deducted?

Reconcile deductor, TAN, amount and period, and seek correction where needed. Claim credit according to the law and portal data after resolving material mismatches.

Can a salaried person with capital gains use ITR-1?

ITR-1 eligibility is subject to specific conditions. Capital gains and other exclusions commonly require another form; verify the notified AY 2026-27 instructions.

Why preserve the filed JSON or utility output?

It provides the exact data submitted and supports later rectification, notice response or comparison with the portal-processed return.

Should a taxpayer wait for every prefilled figure before filing?

Use the current filing calendar and evidence. Do not omit known income merely because a third-party statement has not yet populated, and do not file blindly before core documents are available.
