Advance Ruling: When to Ask Before Taking a GST Position

When an advance ruling can clarify a proposed or ongoing GST position, what questions are permitted, how facts must be framed and why State-specific binding limits matter.

An advance ruling is useful only when the question is legally eligible and the facts are complete. A vague question can produce a narrow answer that becomes difficult to live with.
Section 97 permits advance-ruling questions on specified matters such as classification, notification applicability, time/value, ITC, liability, registration and whether an activity amounts to supply.
An application is not admitted where the same question is already pending or decided in proceedings in the applicant’s case under the statutory bar.

Practical example
A company asks whether its ‘software service’ is taxable at a particular rate but does not attach the licence, implementation and support terms. The authority can only decide the limited facts presented, leaving the actual bundled contract exposed.
How to apply the framework
Draft a neutral statement of facts and identify competing legal views. Include sample agreements, invoices, technical process and the exact relief sought.
Review rulings from other States as research, not binding precedent. Consider whether the risk is better managed through a legal opinion, representation or transaction redesign.

Define the legal question before changing the return
Identify the GSTIN, tax period, transaction, document and exact statutory question. Review question, timing and facts together. Freeze the source data so that later ERP edits do not destroy the evidence used for the decision.
Reconcile from commercial reality to portal data
Start with the contract or commercial event. Move through the invoice, receipt or movement evidence, e-invoice or e-way bill, accounting entry, return and electronic ledger. Classify each difference as timing, error, ineligible amount, statutory exception, disputed position or completed correction. Avoid a plug entry whose only purpose is to make two reports equal.
Record the conclusion and future control
Prepare a concise position note with facts, authority, amount, alternative view and approval. Preserve the filing acknowledgement and update the responsible master data, vendor rule, invoice workflow or monthly checklist. The objective is not only to survive one review but to prevent the same issue in the next period.
