Income-Tax Notice: Your First 48 Hours

Reviewed by CA Nikhil Gupta · Last reviewed 28 June 2026

Received an income-tax notice? Verify it on the portal, identify the section and deadline, organise evidence and submit a clear response without panic.

A notice is not automatically a tax demand or an accusation. The first task is to identify exactly what the department has issued, for which year, under which law and by what deadline.

Quick View

First move

Download the notice and preserve the original file.

Core proof

Notice PDF and email or SMS alert.

Main mistake

Ignoring a notice because no tax seems payable.

Official route

Income Tax Department e-Proceedings manual

What the Issue Means

Open the communication only through the official e-filing account and download the complete PDF. Emails and SMS alerts are useful, but the portal record should be treated as the primary reference. Check the PAN, document identification number, tax period, issuing authority and response date.

Classify the item before preparing a reply. A defective-return notice, proposed adjustment, demand intimation, information request, scrutiny notice and reassessment communication have different consequences. For periods beginning before 1 April 2026, the Income-tax Act, 1961 may continue through the savings provisions even when the notice arrives after that date.

Build an issue-wise response rather than uploading a pile of documents. State the fact, explain the tax treatment, identify the supporting document and reconcile the amount with the filed return, AIS, TIS, Form 26AS or books. Seek professional help early where limitation, reassessment, unexplained credits, foreign assets or large additions are involved.

Action Steps

  1. Download the notice and preserve the original file.
  2. Record the section, tax period and exact due date.
  3. Check whether the communication appears in Pending Actions or e-Proceedings.
  4. Prepare a one-page issue and amount summary.
  5. Collect documents by issue, not by file type.
  6. Submit within time and retain the transaction ID and acknowledgement.

Decision Table

SituationMeaningResponse
Portal checkThe communication is visible in the official account.Do not reply to a lookalike email link.
Legal checkSection, year and governing Act are identified.Old and new Acts can run in parallel.
Fact checkDepartment figure is reconciled with the return and records.A mismatch is not explained by assertion alone.
Submission checkResponse, attachments and acknowledgement are saved.A draft on a laptop is not a filed response.

Practical Example

A salaried taxpayer receives a proposed adjustment for interest income that appears twice in AIS. The correct response is not simply “AIS is wrong.” The taxpayer should identify both entries, attach the bank certificate, show the amount already offered in the return, submit AIS feedback separately and answer the adjustment through e-Proceedings before the deadline.

Evidence to Keep

  • Notice PDF and email or SMS alert.
  • Filed return, computation and acknowledgement.
  • AIS, TIS and Form 26AS downloads for the relevant period.
  • Bank statements, certificates, invoices or contracts supporting the issue.
  • Response note with numbered annexures.
  • Portal acknowledgement, transaction ID and submission timestamp.

Common Mistakes

  • Ignoring a notice because no tax seems payable.
  • Using the filing date instead of the income period to choose the governing Act.
  • Uploading documents without explaining what each one proves.
  • Agreeing with an adjustment merely to close the alert.
  • Waiting until the final day to discover upload-size or portal issues.

Escalation Route

Where more time is genuinely needed, use the portal’s adjournment facility where available and explain the reason. Do not assume that sending an email outside the prescribed channel extends the deadline.

If the reply is not accepted or an adverse order follows, review the rectification, appeal or other remedy within its own limitation period. The next step depends on the type of order; a generic grievance is not a substitute for a statutory remedy.

Working Principle

Deadline control matters more than the volume of attachments. A short, issue-wise response supported by indexed evidence is stronger than an unstructured document dump.

The safest approach is to preserve the original record, use the official channel and explain the facts in chronological order. A portal acknowledgement, complaint number or filing receipt is part of the evidence and should be downloaded rather than assumed to remain available forever.

Rules and procedures can change, and the correct action depends on the exact transaction, policy, notice or account. Where money, limitation, criminal allegations, medical causation or a large tax position is involved, qualified professional advice should be obtained before taking an irreversible step.

Common Questions

Can a genuine notice be ignored if it appears wrong?

No. A wrong premise should be answered with evidence through the prescribed route.

Is every portal message a scrutiny notice?

No. The e-Proceedings service covers several notices, intimations and communications with different effects.

Can an authorised representative reply?

The portal permits adding or withdrawing an authorised representative for covered proceedings.

What should be saved after filing?

Keep the final response, annexures, transaction ID, acknowledgement and the exact version submitted.
